Alabama Cardiovascular Group agreed to a $2.23 million class action lawsuit settlement to resolve claims that it failed to prevent a 2024 data breach that compromised patient information.
The settlement benefits individuals who received a data breach notice from Alabama Cardiovascular Group informing them that their information may have been compromised in a data breach on July 2, 2024.
According to the data breach class action lawsuit, hackers gained access to patient information, such as names, birth dates, Social Security numbers, health insurance information and medical data. The plaintiffs in the case argue that Alabama Cardiovascular Group could have prevented the data breach through reasonable cybersecurity measures.
Alabama Cardiovascular Group is a heart and vascular clinic in Alabama.
Alabama Cardiovascular Group has not admitted any wrongdoing but agreed to a $2.23 million class action settlement to resolve the allegations.
Under the terms of the Alabama Cardiovascular Group settlement, class members can receive either a documented loss payment or a cash fund payment.
Documented loss payments are available to class members who experienced losses as a result of the Alabama Cardiovascular Group data breach. These payments compensate class members for up to $5,000 in documented losses, such as credit monitoring costs, bank fees, fraudulent charges, communication expenses, credit expenses and identity theft losses.
Class members who did not experience losses as a result of the data breach can receive a pro rata cash fund payment. These payments will vary depending on the number of claims filed with the settlement.
All class members are eligible for two years of credit monitoring and insurance services through CyEx Medical Shield Complete. These services include one-bureau credit monitoring and $1 million in identity theft insurance.
The deadline for exclusion and objection is Feb. 4, 2026.
The final approval hearing for the Alabama Cardiovascular Group data breach settlement is scheduled for March 20, 2026.
To receive settlement benefits, class members must submit a valid claim form by March 6, 2026.
Who’s Eligible
Individuals who reside in the United States and received a written notice from the Alabama Cardiovascular Group that their personal information may have been compromised in the data breach.
Potential Award
Up to $5,000 for documented losses or a pro rata cash payment, plus two years of credit monitoring.
Proof of Purchase
Documentation of unreimbursed losses, such as bills, invoices, receipts, bank statements or credit card statements.
