Cummins Behavioral Health Systems Inc. agreed to pay $2.1 million to resolve claims related to a 2023 data breach.
The Cummins Behavioral Health settlement benefits individuals whose personal information was potentially compromised in the data breach, including those who received a data breach notification from Cummins.
According to the class action lawsuit, Cummins Behavioral Health failed to prevent a data security incident that exposed personal information. Plaintiffs claim that the Cummins data breach could have been prevented through reasonable cybersecurity measures.
Cummins Behavioral Health Systems is a behavioral health services provider with locations in Indiana.
Cummins hasn’t admitted any wrongdoing but agreed to a $2.1 million settlement to resolve the data breach class action lawsuit.
Under the terms of the Cummins Behavioral Health settlement, class members can choose to receive one of the following benefits:
- Reimbursement of up to $500 for documented ordinary losses caused by the security incident (i.e., out-of-pocket expenses and fees for credit reports, credit monitoring and other identity theft insurance products purchased as a result of the data breach)
- Payment of of up $75 (at a rate of $25 per hour for up to three hours) of lost time dealing with the security incident
- Reimbursement of up to $5,000 in documented extraordinary losses for damages such as identity theft or fraud related to the data breach
Class members without documented expenses or those who do not wish to claim reimbursement can instead receive an alternative cash payment of $65 or a free trauma screening from Cummins.
The deadline for exclusion and objection is Sept. 23, 2024.
The final approval hearing for the settlement is scheduled for Oct. 7, 2024.
In order to receive Cummins Behavioral Health data breach settlement benefits, class members must submit a claim form by Nov. 20, 2024.

Individuals whose personal information was compromised in the 2023 Cummins data breach including those who received a data breach notification from the company.

Account statements, travel receipts, professional invoices, credit reports, bills, IRS letters, tax documents, police reports and other documentation of losses
