
Avis Budget Group Inc. and Payless Car Rental Inc. have reached a $19 million class action lawsuit settlement to resolve claims that Payless charged unfair fees related to its Gas Service Option (GSO) and Roadside Protection (RSP).
The class action settlement benefits consumers who rented a vehicle from Payless between Jan. 1, 2016, and Nov. 25, 2023, and paid GSO and/or RSP charges.
According to the class action lawsuit, Payless charged GSO and RSP fees even when customers declined these options. Plaintiffs in the case say these fees violated New Jersey’s Consumer Fraud Act.
Payless, a global car rental company, has not admitted any wrongdoing but agreed to a $19 million class action settlement to resolve the allegations. Avis Budget Group acquired Payless Car Rental in 2013.
Under the terms of the Payless car rental settlement, class members can receive reimbursement for some or all of the GSO and RSP fees they paid. Class members who were charged GSO fees can receive up to $20 per rental. Class members who were charged RSP fees can receive up to $12 per rental.
The deadline for exclusion is Nov. 10, 2025. The deadline for objection is Nov. 3, 2025.
The final approval hearing for the Payless settlement is scheduled for Dec. 2, 2025.
No claim form is required to benefit from the class action settlement. Class members who do not exclude themselves will automatically receive settlement benefits.
Who’s Eligible
U.S. and Canadian residents who rented from Payless in the United States between Jan. 1, 2016, and Nov. 25, 2023, and who paid Payless for GSO and/or RSP charges in connection with that rental.
Potential Award
Up to $20 for GSO charges and $12 for RSP charges.
Proof of Purchase
Class members do not need to provide proof of purchase but must submit a unique class member ID to access the class action settlement payment election form.
