Wells Fargo and other companies have agreed to pay $19.5 million to resolve claims that they violated California privacy laws by recording phone calls without consent.
The Wells Fargo settlement benefits individuals and businesses in California who received a phone call from The Credit Wholesale Co. Inc. between Oct. 22, 2014 and Nov. 17, 2023.
Plaintiffs in the Wells Fargo call recording lawsuit claim The Credit Wholesale Co. Inc. recorded phone calls to California businesses without informing the recipients that the calls were being recorded. These calls allegedly violated the California Invasion of Privacy Act (CIPA).
The Credit Wholesale Co. Inc. is a sales organization that sells credit card processing equipment and services on behalf of Wells Fargo Bank N.A. and Priority Technology Holdings Inc.
Wells Fargo and other companies have not admitted any wrongdoing but agreed to a $19.5 million class action settlement to resolve the call recording allegations.
Under terms of the Wells Fargo settlement, class members can receive a cash payment for each eligible call they received. The payment of each call is estimated at around $86, but payments could be as high as $5,000 per call depending on the number of claims filed.
The Credit Wholesale Co. agreed to stop recording appointment-setting calls to California businesses without disclosing any call recording at the beginning of the call.
The deadline for exclusion and objection is April 4, 2025.
The final approval hearing for the Wells Fargo call recording lawsuit settlement is scheduled for May 20, 2025.
In order to receive settlement benefits, class members must submit a valid claim form by April 11, 2025.
Who’s Eligible
All businesses or individuals who received a telephone call from The Credit Wholesale Company Inc. in California between Oct. 22, 2014 and Nov. 17, 2023.
Potential Award
$86 per eligible call and up to $5,000 per call depending on the number of claims submitted.
Proof of Purchase
Claimants must provide their phone number and/or business name that received the calls.
