$19.4M NextGen Healthcare data breach class action settlement

NextGen Healthcare has agreed to a $19.4 million class action lawsuit settlement to resolve claims it failed to prevent a 2023 data breach that compromised patient information.

The settlement benefits individuals identified by NextGen Healthcare as having their private information compromised in the 2023 data breach.

NextGen Healthcare is a health technology company that provides services to more than 1,600 healthcare organizations. In April 2023, NextGen announced it had been the victim of a data breach that compromised sensitive patient information.

According to NextGen, the company detected a third-party cyberattack on April 28, 2023, that resulted in unauthorized access to patient data. The breach compromised names, addresses, dates of birth, Social Security numbers, health insurance information, driver’s license numbers and other sensitive information.

NextGen has not admitted any wrongdoing but agreed to a $19.4 million class action settlement to resolve the allegations.

Under the terms of the NextGen Healthcare settlement, class members can receive compensation for out-of-pocket expenses related to the data breach.

The settlement allows for up to $7,500 in reimbursement for out-of-pocket losses, such as fraudulent charges, identity theft expenses, credit costs, communication charges and more. Class members can also claim up to 10 hours of lost time at a rate of $25 per hour for a total of $250 in lost-time payments.

Class members who did not experience out-of-pocket losses or lost time can still receive a cash payment from the settlement. Class members can receive an alternative cash payment of $50 or $150 if they lived in California at the time of the data breach.

All class members are eligible for three years of identity defense services and restoration services. These services will help class members protect themselves from identity theft and fraud.

The deadline for exclusion and objection is Feb. 12, 2026.

The final approval hearing for the NextGen Healthcare data breach settlement is scheduled for Feb. 17, 2026.

To receive settlement benefits, class members must submit a valid claim form by March 30, 2026.

Who’s Eligible

Individuals who were identified by NextGen Healthcare as being potentially impacted by the data breach.

Potential Award

Up to $7,500 in out-of-pocket expenses and lost time, or a cash payment of $50 (or $150 for California residents) without documentation.

Proof of Purchase

Claimants must submit documentation, such as credit card or bank statements, invoices, telephone records and receipts. Self-written declarations are not sufficient on their own but may be included to provide clarification or context.
