A $115 million Oracle settlement resolves claims the company illegally collected personal information from the internet and sold it to third parties for advertising.

The settlement benefits individuals whose personal information Oracle collected or made available through ID Graph, Data Marketplace or another Oracle advertising product since Aug. 19, 2018.

According to the class action lawsuit, Oracle tracked web activity, in-store purchases, geolocation and other personal information without consumer consent. The company allegedly sold this information to third parties for advertising use.

Oracle is a cloud applications provider that partners with companies such as Uber, AMC, MGM Resorts and more.

Oracle hasnโ€™t admitted any wrongdoing but agreed to a $115 million settlement to resolve the data privacy class action lawsuit.

Under the terms of the Oracle settlement, class members can receive an equal share of the net settlement fund. Exact payments will vary depending on the number of claims filed, the amount deducted for fees and other factors. No payment estimates are available at this time.

Oracle also agreed not to capture user-generated information from referrer websites or forms on its own websites. Additionally, the company will implement an audit program to review its privacy obligations.

The deadline for exclusion and objection is Oct. 17, 2024.

The final approval hearing for the settlement is scheduled for Nov. 14, 2024.

To receive Oracle settlement benefits, class members must submit a valid claim form by Oct. 17, 2024.

  1. angel says:

my husband got the email. does that mean he should submit claim?

  2. John Campbell says:

How much will each class member get? Individual payouts hinge on total claimants but could be extremely low if there is an extremely large number of claimants.
When will class members be paid? Class members can expect their settlement money within a few months of the final approval hearing, assuming the judge signs off and no appeals delay distribution.
What if I had multiple devices Oracle collected data from? You may submit only one claim form regardless of number of devices.
Will Oracle still gather user data after the settlement? Oracle must stop collecting certain user-generated URL content and web form inputs.
What happens to my data Oracle already collected? The settlement doesnโ€™t require data deletion but Oracle stated it will eventually purge ad tech data.
    1. Understand the Lawsuitโ€™s Allegations

Invasion of Privacy: Oracle accused of secretly amassing digital dossiers on people without consent.
Tracking Online & Offline Activity: Lawsuit claimed Oracle tracked usersโ€™ web browsing, purchases, location and more.
Selling Access to Data: Allegations that Oracle sold/gave access to trove of personal data to third parties.
Violations of Law Asserted: Plaintiffs alleged violations of federal wiretap law, CA & FL privacy/consumer statutes.
Oracleโ€™s Position: Oracle denied wrongdoing and defended practices as lawful and disclosed to users.

    Key Takeaways:

Oracle allegedly gathered data on consumers from online and real-world sources without consent to sell access to.
The lawsuit claimed this compilation of personal digital dossiers violated privacy rights and wiretap statutes.
Plaintiffs sought to represent a class of U.S. residents whose data Oracle collected from 2018-2024.
Oracle disputed the allegations but agreed to a large settlement to end the litigation.
Eligible class members can now claim a share of the $115 million settlement fund.

    FAQs:

What data was Oracle accused of wrongfully collecting? The suit alleged Oracle tracked and compiled peopleโ€™s web browsing histories, online and offline purchases, geolocation, and other info.
Did Oracle admit fault in settling? No, Oracle expressly denies the allegations and admits no wrongdoing or liability by settling.
What Makes Someone Eligible for a Payout in the Oracle Case? U.S. residents whose data Oracle collected between Aug. 2018 and the date the court grants final approval.
What brands were involved in Oracleโ€™s alleged data collection? Plaintiffs claimed Oracleโ€™s โ€œID Graphโ€ and โ€œData Marketplaceโ€ products aggregated info on consumers.
How do I know if Oracle had data on me? Most class members likely wonโ€™t know for sure, but if you live in the U.S., youโ€™re probably included.

  3. John Campbell says:

If 1 million class members file valid claims from the estimated 220 million member class, each claimant would get about $78.

  4. John Campbell says:

FYI to all checking on this. I did this on my cell phone with no issues. Internet browsers never worked.

  5. m graham says:

Found claim form online on google search when you type in katz privacy settlement look for Amazon web services site .it will say claim form and you can download and print it off. As I also tried different browsers , web sites that had info and got same message.

  6. Bev G says:

The links to file online in this article do not work nor do the links in the official email from Katz-Lacabe law firm with a claim number. If the law firm is getting paid from the settlement but people cannot file a claim, does a lower number of claims increase their share?

    1. Deborah Deverell says:

I had the same problem, suxs

  7. Russell Renfrow says:

    Curious if I qualify

  8. Joe lindsey says:

How would I know if my data was sold?
I received the email and assume I got it for a reason. 6 years is a long time to remember where I may have used my credit card.

  9. Tracy Pincelli says:

My husbandโ€™s paycheck is from Oracle. Is that the same?

  10. Richard Clemens says:

How do I find out if I qualify?

    1. Liz says:

I received an email from the attorneys handling the claim. It had a link to the claim form. I was an Oracle employee for many years, including those covered by this lawsuit. Iโ€™m not sure if thatโ€™s why I got the email but wanted to mention it.

      1. Omarie Kinman says:

I received the email as well though their information is obviously more accurate than my brain with regards to explaining why I am included.
I would guess, if you received the email, you are pre-qualified.

        1. Stephanie Stone Young says:

I received an email as well but canโ€™t access the claim form. All I get is an error message when I try to go to the website. Any idea why ?
