Massachusetts or U.S. residents who received medical care in Massachusetts who visited certain information websites may be eligible for a payment thanks to a recent $18.4 million Partners Healthcare System class action lawsuit settlement.

Settlement Class Members include all Massachusetts residents and U.S. residents who received medical care at Partners Healthcare System — now Mass General Brigham — in Massachusetts who visited the following informational websites between May 23, 2016, and July 31, 2021: massgeneralbrigham.org, massgeneral.org, brighamandwomens.org, and dana-farber.org.

Plaintiffs in the Partners Healthcare lawsuit allege these websites were set up with specific third-party analytics tools, cookies, and pixels. 

When the plaintiffs visited the websites, their internet browsers allegedly disclosed information about their internet use to these third parties. Further, plaintiffs say, the data transfer was never disclosed to them, and they never gave consent to have their data harvested by the websites.

The health system denies the allegations in the class action lawsuit, does not accept any liability, and does not agree with the claims that settlement Class Members sustained injuries or damages. Rather, it is adamant it has the proof to defend themselves against the claims.

The Court did not review the facts surrounding this class action settlement. Instead, all parties believe the proposed settlement agreement provides an acceptable solution to the issues brought about in the class action lawsuit.

According to the company’s website, Mass General Brigham is the largest private employer in Massachusetts. In the third quarter of 2021, they made profits exceeding $128 million. 

Class Members who file a claim will receive a proportional share of the settlement fund after attorneys’ fees and other expenses are deducted. 

Each Class Member will be eligible to receive a payment of up to $100, depending on the number of claims filed.

A final approval hearing in the Partners Healthcare System data privacy lawsuit settlement is set for Jan. 18, 2022.

Class Members who do not agree with the terms of the settlement have a right to file an objection by Dec. 30, 2021. 

Class Members who are eligible to receive compensation but fail to take action will not receive a payment. Despite that, they’ll still be bound by the terms of the Settlement, which means they will not be eligible to seek out a future lawsuit against the Company regarding this matter.

Eligible Class Members who want to receive their share of the settlement fund must file a timely claim.

The deadline to file a claim is Dec. 15, 2021.
