Current or former Hyatt employees who scanned their fingerprint using the company’s timekeeping system may be eligible for compensation in the form of a cash payment thanks to a recent Hyatt class action settlement.
Settlement Class Members include current or former Hyatt employees who scanned their fingerprint using the company’s timekeeping system as a requirement for employment at these locations during the following periods and who were not subject to a collective bargaining agreement:
- Hyatt Lodge: Oct. 30, 2012, to Feb. 16, 2018
- Regency McCormick Place: Oct. 30, 2012, to Dec. 12, 2018
- Park Hyatt Chicago: Oct. 30, 2012, to Dec. 116, 2018
- Hyatt Regency O’Hare: Oct. 30, 2012, to Dec. 31, 2017
- Hyatt Regency Chicago: Oct. 30, 2012, to Dec. 3, 2018
In the class action lawsuit, plaintiffs allege the company used the fingerprint technology without complying with the Illinois Biometric Information Privacy Act (BIPA). This law prohibits companies from capturing, obtaining, storing, transferring, or using biometric information (like fingerprints) for any purpose including timekeeping without providing written disclosures. The law also says written consent must be obtained before using the biometric information.
Hyatt operates a number of hotel brands at locations worldwide, including in North America, Europe, South America, and Africa.
According to the Hyatt employees fingerpint scan class action settlement, the company denies violating the Biometric Information Privacy Act, and they contest all the plaintiffs’ claims.
The Court did not make any ruling in this case. Instead, both parties concluded the proposed settlement agreement is in their best interests.
Hyatt Class Action Settlement Benefits
According to this proposed settlement, each Class Member who files a claim is eligible to receive compensation. The exact amount of this cash payment is unknown at this time, but each Class Member will receive an equal share of the fund after all other expenses are paid out.
Class Members have the right to exclude themselves from the current settlement. Class Members that exclude themselves will not be eligible to receive a payment, but they can pursue future lawsuits. The deadline to file an exclusion is Dec. 3, 2021.
Class Members also have the right to object to the current settlement by Dec. 3, 2021.
Eligible Class Members that do nothing will not receive money from the settlement fund, and they will lose the right to seek out future litigation regarding this matter.
The deadline to file a claim in the Hyatt settlement is Dec. 24, 2021.
Who’s Eligible
Class Members include current or former employees who scanned their fingerprint using Hyatt’s timekeeping system as a requirement for employment at these locations during the following periods and who were not subject to a collective bargaining agreement:
