Fuel gauge indicates tank is full - fuel senders

Yazaki and DENSO, manufacturers of fuel senders, have agreed to a settlement that will provide $320,000 to direct purchasers of their companies’ products.

The Class includes anyone who purchased fuel senders in the United States directly from any of the defendants during the period from Jan. 1, 2001, through Dec. 27, 2016.

The exact payout amounts Class Members can expect is unknown, but the $320,000 will be distributed on a pro rata basis as soon as the settlement administrator is able to review and audit the claim forms and make their recommendations, and after the Court grants final approval.

Fuel senders are the devices in a vehicle’s fuel tank that measure the amount of fuel the tank contains, according to the settlement website.

A class action lawsuit accused the defendants of working together to raise, fix, and stabilize prices, as well as of other antitrust practices, according to a news release about the settlement.

The defendants deny all allegations of wrongdoing but have agreed to settle the class action lawsuit to avoid ongoing litigation.

The lawsuit claimed that Defendants conspired to raise, fix, maintain, and stabilize prices, rig bids, and allocate the supply of Fuel Senders sold in the United States, in violation of federal antitrust laws.

As part of the fuel senders settlement, Yazaki will pay $220,000, while DENSO will pay $100,000.

Class Members will need to file a claim form in order to receive a payment.

The settlement notice advises consumers not to dispose of any documentation of their qualifying purchase of a fuel sender.

The documentation may be needed in order to complete and substantiate the claim, which will be subject to inquiry and verification. 

A hearing in the case is scheduled for June 10, 2021.

The deadline to opt out of or object to the settlement is April 28, 2021.

The deadline to file a claim in the fuel senders settlement is June 14, 2021.

Who’s Eligible

Anyone who purchased fuel senders in the United States directly from any of the defendants during the period from Jan. 1, 2001, through Dec. 27, 2016.

Proof of Purchase

Invoices, purchase journals, accounts payable journals, etc.

  • Claimants must base their purchase information on these records. When records are not available, the claimant may submit their purchase information based on estimates derived from extrapolating from similar circumstances in the same year (for which the claimant has documentation), extrapolation from the same or nearly the same circumstances in other years (for which the claimant has documentation), or from reports of actual or estimated vehicle production and personal records or estimates of the value of fuel senders content per vehicle.
  • Those who submit purchase information based on estimates or sales data and trends may be required to explain how they calculated the estimated purchases and to provide the documents used as a basis for the estimates.

  • Retain your documentation until this litigation has been concluded and the claims review process has been completed.
