Nonstop Administration and Insurance Services agreed to a $1.6 million class action lawsuit settlement to resolve claims that it failed to prevent a 2022 data breach that compromised sensitive employee information.

The Nonstop Administration and Insurance Services settlement benefits individuals in the United States whose protected health information and/or personally identifiable information was exposed to unauthorized third parties as a result of a data breach the company discovered Dec. 22, 2022.

The settlement also benefits a subclass of class members who lived in California at the time of the breach.

According to the Nonstop Administration and Insurance Services class action lawsuit, the company failed to prevent a data breach that compromised sensitive employee information, such as names, Social Security numbers, driver’s license numbers, health insurance information and more. Plaintiffs in the case argue Nonstop Administration and Insurance Services should have implemented reasonable cybersecurity measures to protect their information.

Nonstop Administration and Insurance Services is a third-party administrator that provides insurance and administrative services for self-funded health plans.

Nonstop Administration and Insurance Services hasn’t admitted any wrongdoing but agreed to the $1.6 million settlement to resolve the data breach class action lawsuit.

Under the terms of the Nonstop Administration and Insurance Services settlement, class members can receive reimbursement for out-of-pocket losses related to the data breach. These losses can include up to $5,000 for unreimbursed fraud, identity theft, bank fees, credit monitoring costs and more.

Class members can receive an alternative cash payment estimated to be around $50. However, these payments may be higher or lower than estimated depending on the number of claims filed with the settlement.

California subclass members can also receive statutory payments of $100 if they were residents of California from Dec. 22, 2022, to Feb. 12, 2025. These payments may be increased or reduced depending on the number of valid claims filed and other factors.

The deadline for exclusion and objection was Jan. 13, 2025.

The final approval hearing for the Nonstop data breach settlement is scheduled for March 18, 2025.

To receive settlement benefits, class members must submit a valid claim form by Feb. 12, 2025.

Who’s Eligible

Individuals in the United States whose protected health information and/or personally identifiable information was exposed to unauthorized third parties as a result of a data breach Nonstop Administration and Insurance Services discovered Dec. 22, 2022.

California subclass: Individuals whose information was exposed in the data breach and who were California residents between Dec. 22, 2022, and Feb. 12, 2025.

Up to $5,100

Account statements, receipts, order confirmations, invoices, travel receipts, credit reports, IRS letters, tax forms, financial documents, etc.
