Saks Off 5th has agreed to a $1.5 million settlement to resolve claims it advertised false discounts on its products in order to trick customers into making purchases.
The Saks settlement benefits consumers who shopped at a Saks Off 5th store in California or online at saksoff5th.com between Jan. 1, 2011, and Nov. 1, 2024, and who have not received a refund or credit for their purchases.
Tier 1 subclass members are those class members who received an email settlement notice. Tier 2 subclass members are those class members who did not receive an email settlement notice.
According to the class action lawsuit, Saks Off 5th advertised false discounts on its products by marking up the prices of its products before marking them down. This allegedly caused consumers to believe they were getting a better deal than they actually were.
Saks Off 5th is a discount retailer that sells clothing, shoes, accessories and home goods.
Saks Off 5th hasn’t admitted any wrongdoing but agreed to provide $1.5 million in benefits to resolve the false discount class action lawsuit.
Under the terms of the Saks settlement, class members can receive a merchandise certificate worth up to $20. If the total value of merchandise certificates claimed by Tier 2 class members exceeds $1.5 million, the value of the certificates will be reduced on a pro rata basis. Certificate values for Tier 1 class members will not be reduced.
Merchandise certificates may be used on sale items but cannot be redeemed for cash, used to purchase gift cards or services or combined with other merchandise certificates from the Saks Off 5th settlement. The certificates do not expire and are transferable.
Tier 1 class members who received a direct email notice of the settlement will receive a merchandise certificate without having to submit a claim form. Tier 2 class members who did not receive a direct email notice must submit a valid claim form in order to receive a merchandise certificate.
The deadline for exclusion and objection is March 16, 2025.
The final approval hearing for the Saks Off 5th settlement is scheduled for April 18, 2025.
In order to receive settlement benefits, class members must submit a valid claim form by March 16, 2025.

Consumers who shopped at a Saks Off 5th store in California or online at saksoff5th.com between Jan. 1, 2011, and Nov. 1, 2024, and who have not received a refund or credit for their purchases.
