
Nissan North America agreed to pay $1.5 million to resolve claims it failed to prevent a data breach that occurred in November 2023.
The Nissan settlement benefits individuals who received a notice that their information may have been compromised in a Nissan North America data breach that occurred on or around Nov. 7, 2023.
Nissan North America is an automotive company that sells vehicles under the Nissan and Infiniti brands. The company has more than 1,000 locations in North America, according to its website.
In November 2023, Nissan North America announced it was the victim of a data breach that compromised sensitive information of more than 50,000 employees. According to the company, the Nissan data breach was the result of a phishing attack.
Plaintiffs in a class action lawsuit against Nissan argue the company could have prevented the breach through reasonable cybersecurity measures. The data breach class action lawsuit claims Nissan’s failure to implement reasonable cybersecurity measures violated consumer privacy rights.
Nissan has not admitted any wrongdoing but agreed to a $1.5 million class action settlement to resolve the allegations.
Under the terms of the Nissan settlement, class members can receive either a cash payment or a credit monitoring benefit.
Class members who experienced documented losses as a result of the Nissan data breach can receive up to $450 for ordinary losses, such as bank fees, postage, travel costs and notary fees. Class members can receive up to $4,500 for extraordinary losses, such as fraudulent charges, identity theft or other damages supported by documentation, such as a police report or insurance claim.
Class members who did not experience documented losses can receive an alternative cash payment of up to $100. This payment may be reduced on a pro rata basis depending on the number of claims filed with the settlement.
All class members, regardless of whether they experienced losses, can receive two years of free credit monitoring. This service includes one-bureau credit monitoring and identity theft insurance of up to $1 million. Class members who enrolled in free credit monitoring offered by Nissan can receive an additional two years of credit monitoring.
The deadline for exclusion and objection is April 24, 2026.
The final approval hearing for the Nissan settlement is scheduled for June 1, 2026.
To receive settlement benefits, class members must submit a valid claim form by May 26, 2026.
Who’s Eligible
Individuals who received a data breach notification from Nissan North America informing them that their information may have been compromised in a November 2023 data breach.
Potential Award
Up to $4,500 in extraordinary losses, up to $450 is ordinary losses or a cash payment estimated at $100.
Proof of Purchase
Class members must provide documentation of their losses, such as bank statements, invoices, receipts, bills, credit reports or police reports.
