Updates:

On Oct. 19, 2020, the Court approved updates to the Settlement Agreement that include extending the date to file your claim, submitting an exclusion request, and filing an objection. Additionally, the updated Roundup Settlement provides that, in the event that the total value of claims falls short of the amount in the Common Fund, payments will be increased from 10% of the weighted average retail price of the products claimed to an amount not to exceed 50% of the weighted average retail price of the products claimed.

The updated Roundup Settlement also identifies the applicable statutes of limitations for Class Members who purchased the Products in any U.S. territory. If you have already filed a claim, no further action is needed in order for you to be eligible for the potential increase in payment; however, you may choose to amend your current claim submission or withdraw your exclusion request. If you have not already filed a claim, information on filing a claim is provided below.

A $39,550,000 settlement has been reached in a Roundup® Weed & Grass Killer class action lawsuit alleging that labeling on certain Roundup® Weed & Grass Killer products are false and misleading. The Roundup settlement includes consumers who purchased one of the following Roundup® Weed & Grass Killer products that includes the statement “targets an enzyme found in plants but not in people or pets” or a similar assertion on the labeling.

  • Roundup® Ready-to-Use Weed & Grass Killer III;
  • Roundup® Ready-to-Use Weed & Grass Killer Plus;
  • Roundup® Weed & Grass Killer Concentrate Plus; or
  • Roundup® Weed & Grass Killer Super Concentrate

The Roundup® class action lawsuit claimed Monsanto falsely labeled certain products, reasoning that Roundup® Weed & Grass Killer only targets an enzyme in plants and not in people or pets.

This Roundup® class action lawsuit is about product labeling, not personal injury. Plaintiffs argue Monsanto was unjustly enriched and consumers economically damaged by the false advertising of the product’s labeling.

“Plaintiffs and other Class Members who purchased the Roundup® Products suffered economic damages in a similar manner because they purchased more Roundup® Products and/or paid more for Roundup® Products than they would have had they not been deceived,” the complaint stated, noting the plaintiff was not seeking any damages for personal injuries as part of the Roundup® class action lawsuit.

Monsanto admitted no liability, but agreed to pay $39.5 million to end the class action lawsuit. In addition to paying out Class Member claims, along with plaintiffs’ awards and attorneys’ fees, the company has agreed to change its labeling practices as part of the Roundup settlement.

Specifically, Monsanto has agreed to stop using labeling that indicates Roundup® Weed & Grass Killer only targets an enzyme found in plants. The language will be replaced with a statement indicating ingredients target an enzyme “essential for plant growth.”

Class Members will be able to claim partial refunds for certain Roundup® products.

The updated Roundup settlement provides that, in the event that the total value of claims falls short of the amount in the Common Fund, payments will be increased from 10% of the weighted average retail price of the products claimed to an amount not to exceed 50% of the weighted average retail price of the products purchased during the Class Period, which depends on the statute of limitations in the Class Member’s state.

Class Members unable to submit proof of purchase are limited to claim one unit per household per year within the Class Period (with the exception of the largest Roundup® Weed & Grass Killer Super Concentrate product, for which claims are limited to 1 unit every 2 years) and awards as high as $53.15 in the Roundup settlement. Class Members can submit a Claim Form online or by mail and must do so by the extended claims deadline, Feb. 16, 2021.

Class Members who wish to opt out of the Roundup® settlement must do so by Feb. 16, 2021, as well. Objections to the settlement must be filed by March 8, 2021. The final hearing is scheduled for March 11, 2021.

Who’s Eligible

Class Members include those who purchased one of the following Roundup® Weed & Grass Killer products during the Class Period, including:

  • Roundup® Ready-to-Use Weed & Grass Killer III;
  • Roundup® Ready-to-Use Weed & Grass Killer Plus;
  • Roundup® Weed & Grass Killer Concentrate Plus; or
  • Roundup® Weed & Grass Killer Super Concentrate

The products must have included the statement “targets an enzyme found in plants but not in people or pets” or a similar assertion on the labeling.

Potential Award

Up to $53.15 per unit claimed, after pro rata adjustment, without proof of purchase.

No maximum for claims supported by reasonable proof of purchase.

Proof of Purchase

Proof of purchase is required for Class Members whose claims exceed 1 unit per household per year within the Class Period (with the exception of the largest Roundup® Weed & Grass Killer Super Concentrate product, for which claims are limited to 1 unit every 2 years).

    I sent an email to the Lawyer handling the Law Suit explaining the disparity of Payments, some as low as 2.00, up to 200.00. Asking them to launch an investigation to see if there are sticky fingers with the administrators. I had Proof of Purchase and only got 2.51.
