Consumers who purchased Walmart packaged food items can receive as much as $40 — and potentially even more — from a class action settlement. Items covered in this class action settlement include “beef, pork, poultry, fish, and other types of packaged foods marked with unit pricing.”

Those who can benefit from the settlement agreement include U.S. consumers who, between Feb. 7, 2015 and Aug. 26, 2020, purchased weighted goods from Walmart. To be eligible, the weighted good’s price must not have been accurately reflected in the final sales price. Weighted goods include meats sold by the pound, as well as other goods with unit pricing.

In 2019, the Walmart weighted goods class action lawsuit alleged that the retailer had been overcharging consumers for certain goods that were marked as on “sale.”

According to the complaint, Walmart put weighted goods nearing their expiration date on sale; however, customers found that the final sale price they were charged did not line up with the advertised sale price.

According to the complaint, weighted goods usually include perishable Walmart packaged food items, such as chicken, beef, fish and pork. These items are often sold per unit, such as by the pound and marked as such.

The class action lawsuit said under Walmart’s weighted goods pricing scheme, these items were advertised at a reduced price; however, when the items were rung up, the final price did not reflect the advertised sales price, often by a dollar or so.

One example described in the complaint were chicken tenders sold by the retailer in November 2018.

Allegedly, a 1.18-pound package of the tenders was sold for $6.82 per pound. As the expiration date of the Walmart packaged food item approached, the price was reduced to $3.77 per pound. While the item should have sold for a total of $4.45 on sale, it allegedly rang up at $5.93 — resulting in a $1.48 overcharge.

The class action lawsuit claimed Walmart falsely advertised a myriad of weighted products in such a manner. The plaintiff also accused Walmart of engaging in the deceptive sales tactic since at least 2015.

“Consumers are provided with an item’s unit price in addition to its overall price as a tool to help them make informed purchasing decisions,” the complaint said.

The extra dollar or more charged to consumers who thought they were buying an item on sale garnered millions in profits for the retailer, the class action lawsuit alleged.

The Walmart weighted goods class action lawsuit accused the retailer of false advertising, saying the actions were deceptive, unfair and unconscionable. The complaint also claimed that Walmart had violated Federal Trade Commission guidelines that prohibit deceptive pricing.

In August 2020, the parties reportedly agreed to the Walmart weighted goods class action settlement.

Walmart admits no wrongdoing under the terms of the agreement, but will pay up to $9.5 million to end the litigation. In addition, the retailer has agreed to change the way it labels Walmart packaged food items.

Under the terms of the class action settlement, there are three groups of Class Members.

Class Members who cannot provide a receipt or other proof of purchase can claim up to $10. Class Members who can provide receipts, but cannot demonstrate Walmart’s overcharge for the packaged items with the product’s packaging or other materials can claim up to $40. Claims made by Class Members who can provide both a receipt and packaging indicating how much they were overcharged have no limit.

Class Members must submit a claim form either online or by mail to take part. Claim forms, along with the supporting documentation listed above, must be submitted by Jan. 8, 2021.

Those who wish to opt out or object to the class action settlement must do so by Nov. 4, 2020. The final hearing is scheduled for Feb. 26, 2021.

Who’s Eligible

Class Members include U.S. consumers who, between Feb. 7, 2015 and Aug. 26, 2020, purchased weighted goods from Walmart. To be eligible, the weighted good’s price must not have been accurately reflected in the final sales price. Items covered in this class action settlement include “beef, pork, poultry, fish, and other types of packaged foods marked with unit pricing.”

Potential Award

Up to $40, (potentially more).

  • Class Members without proof of purchase can claim up to $10.
  • Class Members who can provide a receipt but not the packaging showing the overcharge can claim up to $40.
  • Claims by Class Members who provide both a receipt and product packaging showing the overcharge are not limited.
  • Class Members will receive a portion of the settlement that depends on the number of valid claims filed.
Proof of Purchase

No proof required; however, Class Members who can provide a receipt and product packaging can claim a larger settlement amount.
