Bitdefender Inc. and Avangate Inc. have agreed to pay a $950,000 settlement after a plaintiff accused them of violating California law on automatic renewals.

Californians who paid for software from Bitdefender Inc. or Avangate Inc. may be eligible to benefit from a class action settlement.

Anyone in California who purchased software or other products from the companies between Dec. 16, 2015, and Sept. 16, 2020, in response to an automatic renewal or continuous service offer qualifies as a Class Member.

Class Members who register by April 19, 2021, are entitled to their share of the $925,000 settlement. If the settlement receives final court approval, each Class Member will receive a portion of the net settlement amount, the sum that remains after attorneys’ fees, litigation expenses, and other settlement administration expenses.

To participate in the settlement and qualify for a monetary payment, Class Members must submit a claim on or before April 19, 2021, which must be validated by a settlement administrator.

To submit their claim, Class Members must enter an ID number, which can be found in a postcard or email they should have received notifying them of the class action settlement, according to the settlement website.

Plaintiff Yolanda DiLorenzo first filed the class action lawsuit against antivirus company Bitdefender Inc. and online payment software company Avangate Inc. in December 2019, alleging that the companies “solicit orders for computer software and related services that purport to be for a fixed period of time” but continue to charge consumers for subsequent periods in violation of California law.

A portion of the state’s False Advertising Law requires companies that make automatic renewal offers to California consumers to first provide “clear and conspicuous” disclosure of the automatic renewal offer terms. The law also prohibits companies from posting charges to consumers’ payment cards without first obtaining affirmative consent to an automatic renewal.

Bitdefender Inc. and Avangate Inc. both deny any wrongdoing, and no ruling has been made in favor of the companies or the plaintiff. Both parties have agreed to a settlement “to provide certain benefits to Class Members and to resolve the case without any admission of liability or wrongdoing.”

A final hearing for the Bitdefender and Avangate settlement has been set for May 14, 2021.

Any Class Members who wish to object to or be excluded from the settlement must complete and return a request for exclusion by mail, email, or personal delivery by April 19, 2021 — the same deadline for claim submissions.

Who’s Eligible

All individuals in California who purchased software or another product from Bitdefender or Avangate between Dec. 16, 2015, and Sept. 16, 2020, and to whom the companies made an automatic renewal or continuous service offer.

Potential Award

Varies. 

Bitdefender and Avangate have agreed to pay a principal settlement amount of $925,000. The amount which each participating Class Member will receive depends on the number of Class Members who submit claims, reduced by the portion of the settlement that will go to attorneys’ fees, litigation expenses, any class representative service payment, and expenses of settlement administration.

Proof of Purchase

No proof of purchase is necessary, but participating Class Members must include an ID number, which can be found in a postcard or email they should have received notifying them of the class action, to submit their claim.

    Bitdefender is still pulling this bait and switch on customers.

    You register and the following year you are auto renewed.

    When you use their products they give you a dashboard and there is there is no way to cancel the auto renewal from the dashboards. There are many ways to buy new or Renew Now and no ways to end auto renewals. Not even a mention of the company 2co.com for 2CheckOut.

    The dashboard design is created to keep a customer trapped in the company forcing them to call amd then asking them what email address was used to purchase the goods or services. The email address you used 1 year ago. If I cannot remember to end the auto renewal, and didn’t remember I have to deal with a different company then how am I to remember 1 of 5 email addresses I use?

    They continue to steal and we need legal help from other states.

    I would sue them again.
