Online game gambling class action lawsuit overview: 

  • Who: Destiny Kennedy filed a class action lawsuit against VGW Holdings Limited, VGW Malta Limited, VGW Luckyland Inc. and VGW GP Limited. 
  • Why: Kennedy claims VGW is violating Georgia law by operating and marketing internet gambling websites Chumba Casino, Global Poker and LuckyLand Slots in the state. 
  • Where: The class action lawsuit was filed in Georgia federal court. 

An online social casino and poker game developer unlawfully operates and markets its internet gambling websites within the state of Georgia, a new class action lawsuit alleges. 

Plaintiff Destiny Kennedy’s class action lawsuit claims VGW Holdings Limited and its subsidiary companies violate Georgia Law by operating casino games on the websites Chumba, Luckyland and Global Poker. 

“Plaintiff lost approximately $1,150, playing the casino games of chance that are promoted and operated by VGW on these internet websites,” the online gambling class action says. 

Kennedy seeks to represent a class of Georgia consumers who suffered losses of money on Chumba Casino, Global Poker, or LuckyLand Slots and VGW during the applicable limitations period. 

Game operator misrepresents gambling websites as ‘just for fun,” class action claims

Kennedy argues VGW represents to Georgia citizens that the websites they operate are “just for fun gameplay” when, in reality, the sites are internet gambling casinos “where Georgia citizens and other customers and consumers wager and lose real money.” 

“VGW proactively defrauds Georgia citizens because VGW advertises that its operations are legitimate and legal when, in reality, VGW knowingly and willfully operates what constitutes an illegal gambling enterprise,” the online gambling class action says. 

Kennedy claims VGW is guilty of violating Georgia Code § 13-8-3. She demands a jury trial and requests an award of monetary relief for herself and all class members. 

A group of consumers filed a separate class action lawsuit against Roblox Corp., Satozuki Ltd., Studs Entertainment and RBLXWild Entertainment earlier this year over claims the companies worked together to allow minors to gamble online using in-game Robux currency.

    I’m sorry it’s just as much of the consumers responsibility to know and be proactive in what’s legal in the state they live in, not reactive after the fact.. I think there are so many other important consumer issues that need to be addressed other than these frivolous lawsuits when the consumer is just as much at fault.

    I think it’s bogus.. you know your gambling .. if you walk into a casino and lose they are not going to give your money back why should Chumba, Luckyland or global poker. If you have sunk over 10,000$ and couldn’t stop after continuously losing there are treatments for addiction to gambling.. this is just buyers remorse for gamblers. No one would be complaining at all if they’d of won more than they lost.

    I have played Global Poker in the state of Georgia for around 2 – 3 years total, if you don’t count the time I was banned. If I had to take a guess, I’d estimate losing upwards of $12,000. I’ve recently started in on Chumba Casino, and Luckyland slots losing around $1,000 to Chumba and only around $150 on Luckyland. They refused to take any action towards my, 150 emails, (literally), about one particular game that would not allow me to utilize the stop button when it was lining up for a big win, yet gave me full control of the stop button when it was conveniently out of place for a win, all the time, every time. Instead, they would use reverse psychology with there chart of responses, and suggest maybe I needed to use their responsible playing tools, as if I was the one that may have some problem. The only problem I had was them not doing a fair job and preying on people like myself, that thought we might have a chance to hit big and make a better life for our families, but in reality, I was hurting my family and making billionaires richer by playing their manipulated games with manipulated algorithms. I have put alot of money into Global Poker with very little return. $12,000 is probably an underestimated figure. Please tell me how I can get in on this class action. I’ve lived in Geogia the past 34 years and I’m 40 years old. I’ve wanted so badly to start a class action myself, which I’ve made clear to them in my emails, so badly but lacked resources and finances. I’ll do whatever is needed to help see this through. Thank you.

    I have lost as lot of money playing Chumba and to top it off I have also won a lot of money on Chumba but they refused to let me cash it out. I won 5000 dollars playing the Twin Spin game last year and they made me do some ridiculous thing to get verified then I had to verify my bank account and even after doing all that crap they never paid me or responded to my emails. Instead they closed my account completely.

    Yup! Lost a lot of money with Chumba who’s been super neglectful in email responses and or refused to refund my money and closed my account after asking about their audit reports
