Online game gambling class action lawsuit overview: 

  • Who: Destiny Kennedy filed a class action lawsuit against VGW Holdings Limited, VGW Malta Limited, VGW Luckyland Inc. and VGW GP Limited. 
  • Why: Kennedy claims VGW is violating Georgia law by operating and marketing internet gambling websites Chumba Casino, Global Poker and LuckyLand Slots in the state. 
  • Where: The class action lawsuit was filed in Georgia federal court. 

An online social casino and poker game developer unlawfully operates and markets its internet gambling websites within the state of Georgia, a new class action lawsuit alleges. 

Plaintiff Destiny Kennedy’s class action lawsuit claims VGW Holdings Limited and its subsidiary companies violate Georgia Law by operating casino games on the websites Chumba, Luckyland and Global Poker. 

“Plaintiff lost approximately $1,150, playing the casino games of chance that are promoted and operated by VGW on these internet websites,” the online gambling class action says. 

Kennedy seeks to represent a class of Georgia consumers who suffered losses of money on Chumba Casino, Global Poker, or LuckyLand Slots and VGW during the applicable limitations period. 

Game operator misrepresents gambling websites as ‘just for fun,” class action claims

Kennedy argues VGW represents to Georgia citizens that the websites they operate are “just for fun gameplay” when, in reality, the sites are internet gambling casinos “where Georgia citizens and other customers and consumers wager and lose real money.” 

“VGW proactively defrauds Georgia citizens because VGW advertises that its operations are legitimate and legal when, in reality, VGW knowingly and willfully operates what constitutes an illegal gambling enterprise,” the online gambling class action says. 

Kennedy claims VGW is guilty of violating Georgia Code § 13-8-3. She demands a jury trial and requests an award of monetary relief for herself and all class members. 

A group of consumers filed a separate class action lawsuit against Roblox Corp., Satozuki Ltd., Studs Entertainment and RBLXWild Entertainment earlier this year over claims the companies worked together to allow minors to gamble online using in-game Robux currency.

    I have lost thousands of dollars to all of these sites but guess what I chose to play I chose to deposit that money. People need to take responsibility for their own actions and stop blaming everyone else!!!

    All the casinos that are mentioned above in the lawsuit being brought against VGW Holdings as well as the ones mentioned in the comments are legal in the United States because they are considered sweepstakes casinos. You purchase gold coins which are solely for the purpose of playing online slots or other casino games. The winnings from the gold coin packages are virtual credits and have no cash value. Sweepstake Coins (or SC’s) are procured along with the Gold coins you purchase but in a much smaller amnt. The Sweeps coins may be used to play games as well..Offering players a chance to win real cash rather than virtual game credits. It should be noted that the rtp on these sweepstake casino slots are not as high as the same slot would be in an actual online casino. If the plaintiff had taken time to read exactly how Sweepstake Casinos work then she would know that they are not operating illegally. If they were running a straight up online casino gaming platform, it would only be accessible to players who live or else are currently visiting a state where gambling is legal (NJ, Miss, PA, WV or LV). The US is very strict in regards to what is and what isn’t allowed in regards to US owned and licensed online casinos.

    My point is simply this. The plaintiff is wasting her time. Don’t waste yours. Don’t believe me?

    Playing at legal online casinos is the only way to guarantee a fair, secure, reliable online gaming experience in Georgia. Sites like WOW Vegas, Pulsz, Chumba Casino, and McLuck adhere to state and federal laws, which are designed to protect consumers.

      So your point is that people should play at “legal” online casinos is exactly how you put it so these online casinos would be considered then illegal. Is that correct? Or am I wrong there and if they are considered illegal or they’re not part of the legal casino category wouldn’t it put them in a category to be held accountable for what it is that they’re doing since what they are doing is putting themselves in a category outside the legal casinos that we have available online?

        They are legal. All of the listed sites are legal. They are considered sweepstakes casinos.

    Definitely ADD ME! I have lost thousands playing Luckyland and Chumba, but also I still have the game installed in my phone and definitely will be deleting it due to this lawsuit

      Same place the Plaitiff is…You win some…You lose some…Gambling is always a game of chance…But the establishments mentioned are operating legally in the US as Sweeps Casinos. The Plaintiff is wasting her time trying to sue for reimbursement. She knew what she was doing. She is making herself look foolish.

      Yes where do I sign up I live in Georgia too and played on all those sites I have text them and email those sites telling them to please block me because gambling was killing me and they didn’t now I have nothing

        You have the option to do that for yourself in their websites. You can also unsubscribe from their promotional email subscriber list or mark as SPAM. You have nothing because you chose to take a chance and gamble in hopes of winning more money than you started off playing with. I’m assuming you didn’t know when to cash out as it would seem you lost money. This is why one should never bet anything other than extra cash that is unaccounted for after bills, gas, food and oth such expenditures have been budgeted out of one’s monthly income.

          Yeah, if they won they wouldn’t be complaining. I’ve lost thousands on online poker and casinos, but it isn’t the casinos fault, it is my fault. I chose to play. They didn’t hold a gun to my head. These are adults! They need to take responsibility for their actions.

    I have lost $ as well. Quite a bit honestly now on one of their sites they are actually charging upwards of 20 to 30 cents over what you chose to spin. I
