StubHub website regarding misleading ticket prices settlementStubHub Canada Ltd. and StubHub Inc. have agreed to pay $1.3 million over allegations it used misleading pricing claims when selling event tickets online.

An investigation by the Competition Bureau found that StubHub advertised tickets online, in promotional emails and via mobile apps at prices that were unattainable for consumers because the listed prices failed to account for mandatory fees that StubHub charged on top of the listed ticket prices.

Consumers were reportedly unable to see the fees when they were looking up ticket prices unless they turned on optional filters to see prices and fees. Without the filters the fees were only revealed after the consumer opted to purchase the tickets. In some cases, the Competition Bureau found that consumers who filtered results to see the prices with fees included still were asked to pay higher prices than they were shown.

As part of the ticket pricing settlement agreement, StubHub will make sure the listed prices for tickets to events in Canada will reflect the total ticket price with mandatory fees included.

StubHub has also agreed to settle a ticket pricing class action lawsuit filed in 2015 by plaintiff Steve Abihsira, who alleged StubHub and other ticket retailers listed misleading ticket prices in violation of the Consumer Protection Act.

In addition to StubHub, the other settling defendants in the ticket pricing class action lawsuit  include eBay Inc., Vivid Seats LLC, TicketNetwork Inc., SeatGeek Inc., Uberseat, and FanXchange Limited.

The settling defendants deny the allegations in the ticket pricing class action lawsuit and maintain that they have complied with all applicable legislation.

Proposed Class Members of the StubHub ticket pricing settlement include all consumers who, since Aug. 28, 2012, lived in Quebec and were located in Quebec when they purchased a ticket from one of the defendants that was either at a price higher than the price announced by the vendor to sell the tickets by the event’s producer and/or who paid a price higher than the price advertised on their websites and/or mobile applications (excluding Quebec sales tax or the Goods and Service Tax).

NOTE: The specific dates of purchase vary somewhat by defendant. Details about the settlement can be found here.

According to StubHub ticket pricing class action settlement documents, Class Members will automatically receive a $24.29 credit.

If you were in Quebec when you purchased a ticket for an event outside of Quebec, you may be eligible for benefits but you will need to submit a claim.

Class Members should be receiving notice of the misleading ticket price settlement via email.

The court will decide whether to approve the StubHub settlement at a hearing on April 30, 2020.

The deadline to opt out of the misleading ticket pricing class action settlement is April 17, 2020. The objection deadline is April 30, 2020.
