A $6.6 million San Diego airport car rental class action settlement has been reached to resolve claims that the city’s port authority unlawfully taxes rentals via fees.

The settlement benefits individuals who got a car rental from San Diego International Airport and were charged a $3.50 fee by rental companies between May 10, 2018 and July 24, 2020. A full list of affected San Diego airport car rental companies is available in the “Who’s Eligible” section below.

Plaintiffs in the San Diego airport car rental class action lawsuit challenged the $3.50 fees charged by rental companies at the San Diego airport, including Enterprise and others. According to the plaintiffs, these fees were a required by the city’s port authority. However, the renters argued that the fees constituted an illegal and unconstitutional tax.

The special tax reportedly stemmed from an April 2018 port resolution which required car rental companies to charge their customers a $3.50 fee. Although requiring certain fees is within the port’s authority, the plaintiffs argued that this specific tax was unlawful because it was not voted on by the public.

“Because the tax was not approved by local voters, it is an unconstitutional tax and thus unlawful and invalid,” the San Diego airport car rental class action lawsuit contended.

The San Diego port authority has not admitted any wrongdoing in the case but has agreed to resolve the claims against them in a settlement. The settlement will reportedly refund around $6.6 million in fees to consumers.

Under the terms of the settlement, Class Members can collect a cash payment compensating them for the $3.50 fee or fees they were charged after securing a car rental from San Diego airport locations. Payment amounts will depend on the number of fees claimed by Class Members. Although payments aim to provide 100% reimbursement for these fees, the settlement terms allow payments to be reduced proportionally if a large number of claims are filed.

In order to benefit from the San Diego airport car rental class action settlement, Class Members must file a valid claim form by Oct. 20, 2020. Evidence of fees is only required for Class Members who claim to have paid the $3.50 fee more than 20 times.

The deadline for exclusion and objection is Oct. 20, 2020. The final approval hearing for the San Diego airport car rental class action settlement is Nov. 13, 2020. Class Members can register on the settlement website to receive email updates about the case.
