Consumers who were charged international AT&T roaming fees without notice may be eligible to make a claim in a class action settlement.
The settlement benefits California residents who were charged international AT&T roaming fees for unanswered incoming calls to their U.S.-based cellphone numbers between Feb. 6, 2005, and Jan. 31, 2009.
The plaintiffs in a class action lawsuit claimed they were charged for calls received but not answered while they were traveling abroad.
The plaintiffs accused defendants AT&T Mobility LLC, New Cingular Wireless PCS LLC and New Cingular Wireless Services Inc. of deceiving customers about how they assessed roaming fees.
AT&T claims the plaintiffs have no legal basis for bringing their lawsuit and contend its practices are accurate and not misrepresented. Though the company denies any liability and that Class Members were injured in any way, they have agreed to a settlement to resolve the litigation.
The AT&T roaming fees settlement provides relief in several forms.
Current AT&T customers who are Class Members will receive a “Day Pass” — one day of free international roaming similar to the AT&T international Day Pass, valued at $10 — to be used on their next international trip within 18 months of receipt.
Current customers who do not want the Day Pass may submit a Claim Form. Those who choose to file a claim will receive a credit on their account that equals the amount they were charged for one-minute calls at international roaming rates between Feb. 6, 2005, and Jan. 31, 2009, up to a maximum credit of $50.
Former customers must file a claim in order to benefit from the AT&T roaming fees settlement. Former customers will receive a cash payment of at least $4, up to a maximum of the total amount they were charged for all one-minute calls at international roaming rates during that same period. The maximum cash refund for former customers is $50.
If a Class Member was already refunded for international roaming charges on unanswered calls during the Class Period, they are not eligible for receive credits or refunds on those charges again.In addition to the monetary relief, the defendants have agreed to add a notice on its Wireless Customer Agreements that reads: “In some countries, you may be charged international roaming rates even for calls that you do not answer.”
A final hearing in the AT&T roaming fees settlement is scheduled for March 17, 2021.
The deadline to file a claim is Feb. 19, 2021. The deadline to opt out of or object to the settlement is also Feb. 19, 2021.
