Certain Boeing Employee Credit Union (BECU) members may be able to benefit from a $6 million settlement resolving claims surrounding the credit union’s non-sufficient funds (NSF) fees.

The Class consists of anyone who resided in Washington, was a BECU member, and at any point between Aug. 2, 2015, and July 1, 2020, incurred an overdraft fee or an NSF fee for a transaction when the amount of the ledger balance shown in the credit union’s record of their BECU account was equal to or greater than the amount of the transaction, or at any point from Aug. 2, 2013, through July 1, 2020, was charged an NSF fee on a transaction for which they had already been charged an NSF fee.

A class action lawsuit had alleged BECU violated Washington law by imposing overdraft and NSF fees when members had a ledger balance — but not an available balance — that was enough to cover the transaction and by charging more than one NSF fee on a single transaction.

Both parties have agreed to a settlement in order to avoid the costs and risks associated with the case trial.

Each Class Member will receive a portion of the settlement fund after attorneys’ fees and other costs are deducted.

The amount each Class Member will receive will depend on how many overdraft fees covered by the settlement they were charged.

Those who qualify and have a BECU account when the payments are distributed will receive their payment as an automatic deposit into their account.

Those who do not have a BECU account when payments are made will receive a check.

Class Members do not need to submit a claim in order to receive their payment.

A final approval hearing in the Boeing Employee Credit Union NSF fees settlement is scheduled for Sept. 24, 2021.

The deadline to opt out of or object to the settlement is Aug. 9, 2021.

Class Members who received a notice by mail or email do not need to do anything to receive a payment.
