Debt collector class action lawsuit overview: 

  • Who: Mayer Silberstein filed a class action lawsuit against The CBE Group Inc. 
  • Why: Silberstein claims The CBE Group attempted to collect on a debt related to his Verizon Wireless account that he says he settled in full. 
  • Where: The class action lawsuit was filed in New York federal court. 

Debt collector The CBE Group attempts to collect debts that have already been settled in full, a new class action lawsuit alleges. 

Plaintiff Mayer Silberstein claims The CBE Group contacted him in June 2023 to collect on a Verizon Wireless-related debt he argues he settled with a separate debt collector, according to the class action lawsuit.

Silberstein also argues “deceptive and false information” in the debt collection letter The CBE Group sent confused him and misled him to believe the debt still existed. 

“Defendant should have done its due diligence before collecting on a debt that was previously settled in full,” the debt collector class action says. 

Silberstein wants to represent a New York class of consumers whom The CBE Group sent a debt collection letter within the past year in an effort to collect an already-paid debt. 

Debt collector misrepresented amount owed in collection letter, class action claims

Silberstein claims The CBE Group violated the Fair Debt Collection Practices Act by misrepresenting the character, status and amount of debt he owed. 

“These violations by defendant were unconscionable, knowing, willful, negligent and/or intentional, and defendant did not maintain procedures reasonably adapted to avoid any such violations,” the debt collector class action says. 

The plaintiff demands a jury trial and requests declaratory relief and an award of actual and statutory damages for himself and all class members. 

A consumer filed a similar class action lawsuit against Transworld debt collection agency early last year over claims the company sent false and misleading debt collection letters.

    I was sent to collections for a debt I paid after contacting the automated system to inquire of my payoff balance. Once I received the amount, I paid it right then. Later, I received notification that I still owed money. I disagreed and refused to pay any additional money to something I paid in full. Late fees and the like kept accumulating until this very day and I’ve informed multiple collection agencies of this. Something needs to be done about this!

    Keystone Collections in Irwin, PA uses any addresses provided by USPS to try to get money. I have not lived in PA for over 3 yrs and this year they tried to collect a second time on a 2021 per capita I already paid. Internet comments suggest that many people have had issues with this outfit.

    I paid off Verizon for my phone worked on the phone with them to pay final bill before could transfer my new account. But they keep sending me a bill

    Need to look into whether accounts settled in a Bankruptcy CH 13, is being paid again. (2010) I had Capitol One CC. I currently have a Kohls CC, and guess who approved it, Capitol One. Yet I am paying TWO interest rates on this. One which is higher is for “purchases” and then the other for Balance. I cannot get a straight answer on this from anyone at company. nor Consumer Protection. On time payments. Only Ch 13 as spouse got sick and became one salary household. It seems companies can sniff out this stuff and suddenly make unrealilisted demands

    Yes! Fraud was committed! Chase Bank NA refuses to acknowledge and trying to recoup the loss after a Scammer/Hacker did something “illegal” and then turned around and maxed out (beyond the credit limit). Have multiple reports from the Sheriff’s Office in addition to complaints filed with the BBB, CFPB, FTC, FCC, and State Attorney! The fraud was already reported and documented! Chase refuses to cooperate with Economic Crimes Division, Sheriff’s, and other authorities!

    US Cellular did this same thing to me. Resold the debt and it was over 7 years ago!
