An Illinois man says that he was subjected to multiple debt collection calls from Nationwide Acceptance despite his pleas for the company to stop while he was recovering from an injury.
In a lawsuit filed in Illinois federal court today, plaintiff Richard Wold says that he fell behind on his car payments after breaking his leg and suffering financial difficulties. He claims that in September of this year, the defendant, Nationwide Acceptance, began calling about the debt.
“On one of the initial calls that Plaintiff answered he was met by a conspicuous lengthy pause and was required to say ‘hello’ numerous times prior to being connected to a representative,” says the Nationwide Acceptance TCPA lawsuit. Wold notes that, during this first call he explained his situation and asked the representative about a payment plan; however, the representative told him that was not an option.
Wold says he then asked Nationwide Assurance to stop calling his cell phone, but, despite his pleas, he began receiving as many as two calls a day from the defendant. Further, the lawsuit notes that the company has not sent the plaintiff anything regarding the debt by mail.
Wold accuses Nationwide of violating the Telephone Consumer Protection Act (TCPA). The TCPA is a federal law enacted by Congress in 1991 to protect consumers from harassing telemarketing behavior. Violations of the TCPA can result in steep penalties of up to $1,500 per call.

Wold says he was harmed by Nationwide Acceptance’s harassing debt collection calls. He claims he has suffered anxiety, emotional distress, and increased wear and tear on his cell phone dealing with the calls.
“Moreover, each time Defendant placed a telephone call to Plaintiff, Defendant occupied Plaintiff’s cellular telephone such that Plaintiff was unable to receive other phone calls or otherwise utilize his cellular telephone while his phone was ringing,” the lawsuit points out.
The plaintiff is seeking a court order stopping the unwanted debt collection calls from Nationwide Assurance, as well as damages of up to $1,500 per call.
