A $1.5 million settlement fund has been established to compensate Mitchell L. Morgan Management tenants for allegedly fraudulent legal fees.
The settlement will benefit individuals who lived at a property managed by Mitchell L. Morgan Management Inc., signed a lease with a fixed $400 attorney’s fee, and were charged a legal fee.

Mitchell L. Morgan Management allegedly had leases which included a provision that, in the case of an eviction, their tenants would be forced to pay a legal fee. The class action lawsuit filed against the management company in 2010 claimed that the legal fees violated the New Jersey Consumer Fraud Act (NJCFA).
The fee allegedly had no real relationship with the expenses involved in an eviction action and would not provide coverage for any counsel fees. Because the “attorney’s fees” were not actually used to pay legal fees, plaintiffs claimed that they were fraudulent and violated the NJCFA.
The defendants argued that the fees were not unlawful and maintained their claims regarding past due amounts owed by tenants. In the end, both the plaintiffs and Mitchell L. Morgan decided to settle the class action lawsuit.
The amount each Class Member can collect will vary depending on a variety of factors. The payment formula used will consider the number and amount of attorney’s fees charged, any credits given to Class Members by Mitchell L. Morgan Management, and any amounts charged that are unpaid or were written off.
In order to receive payment, Class Members must file a claim by Aug. 2, 2019. The deadline for exclusion and objection is July 15, 2019. The final approval hearing is scheduled for Aug. 16, 2019.
Who’s Eligible
Individuals who lived at a property managed by Mitchell L. Morgan Management Inc., signed a lease with a fixed $400 attorney’s fee, and were charged a legal fee for an eviction between Sept. 28, 2007 and either 1) the date that Mitchell L. Morgan Management stopped managing the property or 2) Aug. 2, 2016.

Potential Award
Varies. The amount each Class Member can recover will be calculated using a formula that takes into account the number and amount of attorney’s fees charged, any credits given to Class Members by Mitchell L. Morgan Management, and any unpaid amounts.
