Current and former Anthem 401(k) plan participants and beneficiaries have secured a $23.65 million class action settlement agreement ending claims that the company charged excessive fees.
Class Members include those who participated in or are a beneficiary of an Anthem 401(k) plan, previously known as the WellPoint 401(k) Retirement Savings Plan, between Dec. 29, 2009 and March 31, 2019. Class Members must have maintained a balance of greater than $1,000 during the Class period or invested in the Vanguard Money Market Fund.
Lead plaintiffs accused ATH Holding Co. LLC, an Anthem subsidiary, of charging them and other plan participants exorbitant fees. According to the Anthem 401(k) class action lawsuit, plan participants were also not provided inexpensive investment options — allegedly a violation of the Employee Retirement Income Security Act, also known as ERISA.
ERISA is a federal law that requires companies that offer certain types of retirement and pension plans, as well as insurance plans, to meet certain standards concerning investment options, fees, and recordkeeping. The law also requires financial institutions to put the best interests of plan participants first.
The Anthem 401(k) class action lawsuit claimed that, in addition to charging excessive fees, plan participants who were interested in capital preservation only had one investment option, the Vanguard Prime Money Market Fund, which was far more expensive than other options not available.
ATH Holding Co. agreed to pay $23.65 million to end the Anthem 401(k) class action lawsuit. Under the terms of the settlement, Class Members with active accounts between Dec. 29, 2009 and March 31, 2019 with an account balance above $0 will automatically be allocated an award into their account. Those with an account balance of $0 or lower will automatically receive a check in the mail.
Former participants in Anthem’s 401(k) plan will need to submit a Claim Form by Aug. 26, 2019.
Each Class Members award will depend on the Anthem 401(k) plan they participated in. There are approximately 120,000 Class Members, according to the settlement notice.
Class Members who wish to opt out or object to the Anthem 401(k) class action settlement must do so by Aug. 5, 2019.

I sent this in and never heard any back.
Does anyone have a number or email on who to contact for settlement info? The number listed is now disconnected and I got no response with the old email. I had a stroke so I am playing catch up. Thank you in advance.
I filed the proper paperwork and received a notice that my check was returned to them and that they would reissued another in 3 months this was in December and I have not received or had any response. Please advise. Thank you
I filed the paperwork in 2019, called in 2020 last summer and was advised that I didn’t get nothing because it was $5 or less, but then I got a letter from another company stating that I did receive a check and I filled out their form to have it be issued for which I turn that in back in Dec 2020 still haven’t received my payment.
What is the phone # to talk to person, check not received. # listed is messages(855-263-3447)
I filed the proper paperwork on July 15, 2019 and have not received or had any response. Please advise.
I would like to know why so many of us have not received a payment. We only had the high cost stocks offered to us and should be entitled to some reimbursement.
I explained why below!! They sent forms out to everyone regardless of whether or not you were eligible for this class action. If you call in they will tell you whether you’re getting a check. It all depends on where you had your money invested. And if your refund is less than $5, they aren’t sending them out. I worked there for 15 years, my husband did also and we got nothing.
I too am a former employee and have not received anything and participated in the 401k. I sent claim out in January 2019 and received nothing, no settlement check. I will call tomorrow and see wth is going on…SMH again with this..geez!
I was employed by Anthem from 09/17/90 to 03/21/08 and submitted the Former Participant Claim Form prior to the August 26,2019 time indicated in the letter. I have not received a check as yet and read that checks were sent in March? Please let me know why I have not received a check in the mail.

You know top class has NOTHING to do with the class actions. You’re asking them questions directly and they have no answers. They aren’t the lawyers. They just post the class actions. Just like when people post “add me”.. absolutely nothing happens cause people have to add themselves.
Has anyone received there check?
No, I haven’t
I have not
when will finds be mailed out please?
