A mesothelioma sufferer blames his past Navy asbestos exposure for his illness, and aims to hold makers of asbestos-containing materials liable for his alleged injuries.
Plaintiffs Victor and Karen H. claim that during the course of Victor’s service in the Navy, he was exposed to numerous materials that contained asbestos. They say that Victor developed mesothelioma later in his life, and that his injury was caused by his exposure to these materials.
Allegedly, Victor’s exposure to asbestos-containing materials occurred at a number of locations throughout his career; his Navy asbestos exposure lawsuit claims that exposure was part of the normal course of his work.
Asbestos Lawsuit Claims
Victor and Karen aim to hold Parker Hannifin Corporation, Crown Cork & Seal Company, Honeywell International Inc., Hopeman Brothers Inc., and J.T. Thorpe & Son Inc. accountable for Victor’s alleged injuries. They claim that the companies knew or should have known that the products they manufactured were dangerous to human health and failed to notify him or other employees.
The couple claim that Victor was physically injured by the products produced by these companies, adding that they suffered emotional damage from the trauma of his illness and suffered financial injury due to incurred medical costs to treat his illness. Additionally, Karen claims her own injury from Victor’s illness because it negatively affected their relationship, causing her loss of consortium.
In their Navy asbestos exposure lawsuit, Victor and Karen claim that the companies were negligent in not warning Victor and other consumers that the asbestos in their products and exposure to it has been known to cause health problems including mesothelioma for many years. They and other lawsuits claim the manufacturers failed to warn of the risk to his health in an effort to increase their profits from the sale of these products.
Dangers of Asbestos Exposure
During the course of shipyard work, Victor and many naval employees were required to interact with asbestos-containing products in such a way that the products released asbestos fibers into the air, which are breathed in. The inhalation of asbestos fibers poses a risk to human health, as the fibers can embed in the lungs and cause mesothelioma, asbestos lung cancer, or other asbestos-related diseases.
The risks have been known since the early twentieth century, and studies since continue to enforce this knowledge.
Victor’s claim asserts that he held and handled the asbestos-containing materials in a way that was consistent with their intended use, and was unavoidable in the course of the normal duties of his work.
His Navy Asbestos Exposure Lawsuit is Case No. CGC – 18 – 27654, in the U.S. Superior Court of California, County of San Francisco.
