Northland Investment Corp. has reached a $18.75 million class action settlement with former tenants of an apartment complex in New Haven, Connecticut, who say they were displaced by moldy conditions.

Anyone who lived at the Church Street South apartment complex at any point between Dec. 19, 2013, and Dec. 19, 2016, are eligible to make a claim for cash. Some Class Members may be eligible to claim additional benefits.

A judge granted final approval of the settlement on Feb. 5, 2021, in a virtual court hearing, the New Haven Independent reported. 

Eligible Class Members will be able to claim up to $20,000. It is estimated hundreds of former tenants could be eligible, the Independent reported.

The Church Street South complex consisted of 301 apartments near Union Station, according to the class action lawsuit. The complex was intended to house about 1,000 low-income adults and children.

Real estate developer Northland manages over $3 billion in properties in New England, Texas, and the southern United States, according to the complaint.

Plaintiffs in the class action lawsuit accused Northland of allowing conditions at the complex to deteriorate by spending “much less than necessary on repairs and maintenance, with the plan of allowing the property to become uninhabitable beyond repair and then to raze it and build upscale housing in its place.”

The company allegedly hired incompetent contractors who merely made surface repairs — covering mold stains, patching holds, etc. — rather than addressing the root cause of the issues.

The Church Street South complex underwent several inspections by Housing and Urban Development (HUD) representatives and city inspectors.

Code violations were found in 48 out of 120 apartments inspected by the city in July 2010, according to the class action lawsuit.

A January 2011 carbon monoxide leak from an improperly installed furnace allegedly sent five tenants to the hospital, displaced 26 others, and led to orders from HUD and the city for the complex to remedy the situation.

In January 2013, a HUD inspection revealed “several life-threatening conditions and systemic deficiencies” at the Church Street South complex, according to the class action lawsuit.

And in September 2015, HUD found over 1,000 health and safety deficiencies in the Church Street South complex apartments they inspected, giving the complex a grade of 20 out of 100.

Under the terms of the settlement agreement, Class Members can expect to receive $5,000, plus $3,000 for each year they were on the HUD rent rolls, beginning with December 2013 and rounded to the nearest whole year.

The deadline to opt-out of or object to this settlement has passed.

Class Members who wish to file a claim may do so in one of three ways:

  • Mail: Use the addressed and pre-paid envelope included in the packet you received, or use your own envelope, to send the claim form to the settlement administrator.

The deadline to file a claim in the Church Street South settlement is April 15, 2021.

Who’s Eligible

Anyone who lived at the Church Street South apartment complex at any point between Dec. 19, 2013, and Dec. 19, 2016.

Potential Award

Up to $20,000.

  • Class Members can expect to receive $5,000, plus $3,000 for each year they were on the HUD rent rolls, beginning with December 2013 and rounded to the nearest whole year.
