In a new legal action filed in a Delaware court, multiple manufacturers of asbestos products are named as defendants.
The plaintiff Mary J. filed individually and as proposed representative of her deceased husband’s estate. Mary still lives in Spartanburg, S.C., where she resided with Joe up until his death from mesothelioma on June 3, 2017. He was 77 years old at the time, the same age Mary is now. Joe also left three grown children—James J., Robert J. and Marvin J.
According to the narrative of Mary’s lawsuit, Joe was exposed to fibers from asbestos products through numerous jobs over the years. His occupational life involved military service in the U.S. Army where he worked as a construction worker and machine operator.
He also worked for various construction, chemical, metals manufacturing, and utilities companies as a laborer and maintenance person. In all these capacities, Mary alleges he was exposed to asbestos fibers through the handling of asbestos products for which he was not forewarned. These products allegedly included but weren’t limited to various pipes, fittings, valves, boilers, gaskets, turbines, pumps, and packing.
Mary goes on to indicate that he was also exposed to asbestos products in non-occupational capacities through home remodel projects and car care activities.
Not including former or current “doing business as” names, the extensive list of defendants include Air & Liquid Systems Corp., Amchem Products Inc., Atwood & Morrill Co., Aurora Pump Co., Blackmer Pump Co., BW/IP Inc., CBS Corp., Certain Teed Corp., Cleaver-Brooks Inc., Crane Co., Eaton Corp., Flowserve US Inc., FMC Corp., and Foster Wheeler LLC, among others like Pfizer and Goodyear.
Asbestos Lawsuit Claim
Through her counsel, the complainant seeks to hold the defendants liable for their failure to warn about the dangers of asbestos products, like lung cancer and mesothelioma, whether or not they had actually mined the mineral themselves.
It’s her belief that the accused manufacturers had adequate knowledge about asbestos alternatives that her husband’s mesothelioma could have been avoided. She also claims that information regarding health hazards that asbestos and asbestos products posed were readily available to defendants.
Mary is bringing several counts against the defendants including negligence, willful and wanton conduct, strict product liability, loss of consortium, and wrongful death.
In addition to seeking compensatory damages in excess of $100,000 for pain and suffering as well as financial losses for medical care and funeral expenses, the plaintiff hopes for the assessment of punitive damages to punish defendants for their reckless disregard for the well being of others.
Mary’s Asbestos Products Lawsuit is Case No. N18C-12-173 ASB in the Superior Court of the State of Delaware.
