Plaintiffs Lawrence H. and Everett M. have initiated railroad asbestos claims in a lawsuit against Union Pacific Railroad. The railroad asbestos lawsuit is an FELA personal injury case that alleges that the plaintiffs were exposed to asbestos while working for Union Pacific.
The plaintiffs say in their railroad asbestos claims that as a direct result of their exposure to asbestos while working for Union Pacific Railroad, they have contracted cancer. The railroad asbestos lawsuit says that Union Pacific is severally and jointly liable for all damages sustained by these plaintiffs as a result of their exposure to asbestos.
Plaintiff Lawrence H. says that he worked for Union Pacific Railroad and was exposed to numerous toxic substances including asbestos, environmental tobacco smoke, diesel exhaust, and toxic substances, such as aromatic amines, chromium, cadmium, and other organic chemicals.
Plaintiff Everett M. says that he was also exposed to these same substances which caused him to develop pharynx cancer. Lung cancer was also reported by plaintiff Lawrence, and together these men have filed railroad asbestos claims alleging that Union Pacific is responsible for their injuries and damages because the company failed to prevent or even warn them about exposure.
These railroad asbestos claims are just a small representation of the litigation claims brought forward by men and women who have worked for the railroads and have developed cancer. Asbestos exposure in the work environment has been tied to the development of many different types of cancer, including cancer that affects the colon, ovaries, lungs, and mesothelioma. The resulting railroad asbestos claims say that most often employers are responsible for the injuries sustained directly as a result of these health hazards on the job.
The plaintiffs in the railroad asbestos claims lawsuit allege that asbestos-containing dust and regular exposure to asbestos caused them to develop cancer over the course of many decades working with Union Pacific. Many of the cancers associated with asbestos have long latency periods because it can take a great deal of time between the initial exposure to asbestos and the development of cancer.
Many of the men and women who have developed cancer might not immediately realize that they have grounds for an asbestos exposure lawsuit. When the connection between asbestos and cancer was discovered, many employers reportedly failed to provide protective measures or even warn employees about exposure. Asbestos claims could be the only opportunity for an employee who has sustained an expensive and life-threatening medical condition to pursue recovery of compensation.
Anyone who has worked on a railroad or for a railroad company for a long period of time and developed an asbestos related disease could have grounds to pursue a lawsuit based on allegations of asbestos exposure.
In recent years, more former employees who have been diagnosed with cancer and related claims have reportedly filed railroad asbestos claims to argue that the company could have done more to protect employees from this dangerous work environment that can cause a host of medical issues.
The Railroad Asbestos Lawsuit is Case No. 3:18-cv-00410 in the U.S. District Court for the Southern District of Texas, Galveston Division.
