A lab technician looks into a microscope.A recent mesothelioma lawsuit has resulted in a $70 million settlement for a former laboratory technician and his wife after his diagnosis of mesothelioma cancer.

Plaintiff Charles T. claims that he developed mesothelioma after more than 30 years of workplace exposure to asbestos-containing products and materials. Charles says he worked as a laboratory technician at a biopharmaceutical company from 1976 to 2010, where he came into contact with materials that he claims contained hazardous materials including asbestos.

Charles filed his lawsuit against GEA Mechanical Equipment US Inc. for allegedly distributing products, including centrifuge brakes and clutches, that contained asbestos to his workplace, Nabi Biopharmaceuticals.

According to him, the equipment company knew that their products were dangerous when they distributed them to his workplace, and did not provide him or his employer with a health and safety warning.

The jury in the two week mesothelioma litigation trial found that GEA Mechanical Equipment US Inc. failed to adequately warn Charles of the health hazards associated with their products, as well as distributing contaminated materials.

The damages awarded to Charles and his wife include $50 million for him, $20 million for his wife Constance, and $102,000 to the couple for their past medical expenses. Although their attorneys have stated that they are pleased with the results of the trial, they have called the win “bittersweet.”

Despite the massive financial award, no amount of money can reverse the effects of terminal mesothelioma.
