Car factoryPlaintiff Michael S. is the latest person to lodge a lawsuit over asbestos compensation claims.

When a person is exposed to asbestos either in their workplace, through secondhand exposure from a person who brings it home, or through a product or area of their own home, the consequences might not cause medical problems right away.

The danger of asbestos exposure happens years later. In recent decades, asbestos has been targeted by regulators and safety advocates because of its carcinogenic qualities. While most homes and products today contain minimal asbestos or none at all, those people exposed in the 1990s and before could just now be getting a diagnosis with an asbestos-related disease.

The plaintiff in this most recent lawsuit argues that the defendants, BorgWarner Morse Tech LLC and Honeyville International are responsible for his asbestos related diseases. The lawsuit says that plaintiff Michael had numerous employers, including the United States Marines, auto part stores, and Milford Fabricating.

According to the lawsuit, the plaintiff was exposed to, ingested, and inhaled asbestos fibers from numerous different sources that were installed, manufactured, removed, mined or used by the defendants. These parts included clutches, brakes, gaskets, and other car parts.

The removal, maintenance, installation, use and services of these products over a long period of time, according to the lawsuit, led to the development of medical problems due to asbestos exposure. The lawsuit argues that the defendants knew or should have known that the asbestos fibers inside their products had a poisonous, toxic, and problematic effect for anyone who ingested or inhaled them.

The plaintiff states that he developed lung cancer because of his exposure to asbestos. He discovered his diagnosis of lung cancer in June 2018. He argues that he has suffered emotional pain and suffering, physical pain and suffering, mental anguish, and loss of enjoyment of life.

What Is Asbestos?

Many people who develop asbestos related diseases only do so after a long period of time after their initial exposure. At that point in time, when a patient becomes diagnosed with a medical condition, the victim might have no choice but to initiate asbestos legal claims.

Asbestos compensation claims target one or more defendants for failing to notify the employee about the possibility of asbestos exposure. Numerous products can contain asbestos, including sliding on houses, shingles, vinyl tiles used for floors, and insulation in attics and walls.

Some people are exposed to asbestos materials on the job. As pointed out in this lawsuit, many people are concerned about the possibility of asbestos items inside cars. Asbestos could be found in brake pads, linings, gaskets, and some clutch materials on classic vehicles.

Certain vehicle undercoatings can also contain this hazardous material. Old stock parts and preservation cars can present a risk for asbestos exposure in certain situations.

Some people who have already been exposed to asbestos fibers due to working in the automotive industry decades ago could have developed significant asbestos side effects that might be grounds for a legal claim.

The Asbestos Compensation Claims Lawsuit is Case No. N19C-03-129ASB in the Superior Court of the state of Delaware.
