This mesothelioma lawsuit was filed by a couple from Pennsylvania, alleging the husband had sustained regular asbestos exposure from the products and materials provided by CBS, Crane, and the other manufacturers named in the claim.

Plaintiff couple Barry H. and Brenda H. conjointly filed this mesothelioma lawsuit, claiming this illness permanently impacted their marriage and general quality of life.

Asbestos Exposure Claim

According to the mesothelioma lawsuit, Barry had worked with asbestos containing products during his employment at the Portsmouth Naval Shipyard. During his employment at the naval shipyard, Barry says he performed a variety of jobs involving installing contaminated products and had sustained regular occupational asbestos exposure in result.

Due to this regular asbestos exposure, Barry says, he ultimately developed and was diagnosed with mesothelioma.

The couple says Barry has been contending with the disease ever since, with the mesothelioma lawsuit alleging the disease was directly caused by the asbestos fibers he inhaled while on his former job site.

The asbestos fibers were reportedly released from products manufactured, distributed, purchased, and installed contaminated products, which were then inhaled by Barry and other employees.

Overview of Asbestos Mesothelioma Problems

Mesothelioma is a very rare form of lung cancer, which manifests in the lining around the lungs and is specifically caused by asbestos exposure.

While asbestos fibers are harmless when dormant, they become dangerous once released into the air. If the asbestos fibers are inhaled or swallowed, they can become embedded in the lungs and cause scarring. This ultimately leads to the development of mesothelioma or other asbestos related health problems, many of which have no cure and are life long conditions.

Mesothelioma is a very slow progressing disease, often taking up to 50 years for patients to exhibit any symptoms. This means that patients are oftentimes diagnosed at a latent stage, and will most likely not have many treatment options.

Asbestos was popularly used before the 1980s for numerous construction and manufacturing purposes, due to how cheap it was to use and its fire and chemical resistant properties. Numerous United States Navy shipyards and vessels had asbestos implemented for insulation purposes, which means many veterans and workers were exposed to asbestos on a regular basis.

Through the 1970s and 1980s, federal and state regulators greatly restricted the use of asbestos and implemented strict policies when removing the fibrous material. These policies prevent asbestos from leaking into the surrounding environment, which protects nearby occupants and employees.

According to the mesothelioma lawsuit, CBS Corporation and the other manufacturers named in the claim were allegedly aware of the dangers associated with asbestos exposure from the 1930s. The companies and the public reportedly received numerous medical studies and reports from the 1930s to the 1960s and beyond that indicated a correlation between deadly lung disease and asbestos exposure.

Even though these companies allegedly knew about the dangers linked to asbestos exposure, Barry says he was not provided any disclosures or protective equipment. Barry and Brenda are seeking a multitude of damages in their mesothelioma lawsuit, including counts of negligence and failure to warn.

This Mesothelioma Lawsuit is Case No. 3:18-cv-02075-WWE, filed in the Superior Court, J.D. of Fairfield at Bridgeport.
