A judge granted a restraining order against Texas Right to Life, an anti-abortion organization, to protect Planned Parenthood in Texas from lawsuits filed under the state’s new and controversial law restricting access to abortions.
The restraining order temporarily prevents Texas Right to Life from filing lawsuits against Planned Parenthood for being an abortion provider, which the anti-abortion group announced it would do following the passage of Texas Senate Bill 8 (SB 8). SB 8 bans abortions after six weeks and allows “any person” who is not a government official to sue anyone who provides an abortion after six weeks, “aids or abets” such abortions.
The judge stated in her order that allowing Texas Right to Life to utilize the private enforcement mechanism would cause “probable, irreparable and imminent injury” and bars the organization, along with “any and all parties and persons in active concert and participation with them” from suing Planned Parenthood in Texas.
Planned Parenthood Texas Restraining Order Result of State’s Abortion Ban
Under SB 8, anyone can file a lawsuit against abortion providers or other abortion-related entities, even without the need to allege or prove injury or damages.
Planned Parenthood Texas filed for the restraining order and to put a permanent stop to SB 8, arguing that the bill allows individuals and entities to sue physicians and those seeking abortions for their own political or economic gain.
The advocacy group and women’s health provider also argues that the bill opens the door for frivolous, harassing, and abusive lawsuits, which contradicts established civil-litigation and constitutional rules.
Indeed, empowered by SB 8, Texas Right to Life quickly announced its intention to bring lawsuits against abortion providers and allies. It also launched recruitment efforts for informants to provide information about Planned Parenthood’s perceived violations.
SB 8 and its enforcement will cause irreparable harm to abortion patients and abortion providers, including Planned Parenthood, its physicians, and its staff, contends the group’s legal action.
In addition to the restraining order, Planned Parenthood is also seeking judgments against Texas Right for Life and Seago declaring that S.B. 8 violates the Texas Constitution and that Planned Parenthood and its staff’s activities cannot be liable under the bill
