A Texas resident recently filed a new lawsuit against Atrium Medical Corp., alleging that she was implanted with a defective Atrium C-Qur mesh, which caused serious injuries.
The plaintiff, Anna-Katrina K., was implanted with the Atrium C-Qur mesh device on Feb. 17, 2011. Unfortunately, after being implanted with this product to repair her hernia, she says she began suffering from abdominal pain.
Eventually, Anna-Katrina says she suffered from re-herniation, forcing her to undergo an additional surgery due to device failure. The plaintiff says she had her Atrium C-Qur mesh explanted on Sept. 29, 2015.
After the allegedly defective Atrium C-Qur mesh was removed, the plaintiff turned to litigation over the side effects she suffered. According to the lawsuit, Atrium failed to warn about the risks associated with its defective device, leading to her injuries.
Anna-Katrina filed her lawsuit on March 21, 2018, in the U.S. District Court for the District of New Hampshire. The lawsuit was filed on multiple counts, including negligence, design defect, manufacturing defect, failure to warn, breach of express and implied warranties, and several others.
Hernia Mesh Device Basics
Hernia repair mesh like Anna-Katrina’s Atrium C-Qur mesh is a popular method of repairing the damage done by a hernia. Hernia repair mesh is a kind of woven material used to reinforce a weak area or patch a hole.
Unfortunately, patients may actually suffer from serious complications due to the hernia repair mesh itself. For some patients, hernia mesh complications may appear immediately after the surgery, but for others, such symptoms may not appear for weeks, months, or even years afterward.
Serious hernia repair mesh problems are surprisingly common: between one and eight percent of patients implanted with hernia repair mesh end up developing some kind of infection related to their mesh.
Hernia Mesh Failure
Patients may experience a number of serious problems due to implantation with a hernia mesh device like the Atrium C-Qur Mesh, including hernia mesh failure. Patients have reported experiencing, among others, the following hernia mesh failure problems:
- Chronic pain
- Hernia recurrence
- Rejection of the mesh
- Infection
- Device migration
- Scarring
- Inflammation
- Organ adhesion
- Erosion
- Tissue and nerve damage
- Death
Some problems, such as device migration, can later lead to more serious complications like infection, adhesion, and device failure. In many cases, side effects are severe enough that patients are forced to undergo revision surgery to remove the device completely.
Filing a Lawsuit Over Hernia Mesh Failure
If you or someone you love has suffered from hernia mesh failure or other side effects after undergoing hernia repair with Atrium C-Qur mesh or a similar product, you may be able to file a lawsuit and seek compensation for your injuries. While filing a lawsuit cannot take away the pain and suffering caused by hernia mesh failure, it can help to alleviate the financial burden caused by medical expenses and lost wages.
The Atrium C-Qur Mesh Lawsuit is Case No. 1:18-cv-00234, in the U.S. District Court for the District of New Hampshire.
