Another patient implanted with a M2a Magnum hip implant has filed a lawsuit against Biomet, alleging serious side effects of the device.
The plaintiff, James O., alleges that the M2a Magnum hip implant he received during his hip replacement was defective, and failed far earlier than it should have, causing serious and even permanent injuries.
James says he was implanted with a M2a Magnum hip implant device during right total hip replacement surgery on Dec. 2, 2008. Unfortunately, in the months and years following the surgery, James says he began to suffer from serious symptoms.
Indeed, according to James’s lawsuit, the M2a Magnum hip implant caused symptoms like “debilitating pain, discomfort, soreness, dysfunction, and loss of range of motion.” He says his injuries include metal poisoning and metallosis, as well as substantial medical expenses.
Because of these complications, James alleges, he had to undergo revision surgery in February 2017 in order to remove the failed M2a Magnum hip implant. The revision surgery itself brings on further risks of greater complications.
James alleges that Biomet was aware of the defects associated with its hip implant device, yet failed to adequately warn the public and the medical community about these risks.
James filed his M2a Magnum hip implant lawsuit on Nov. 30, 2018, in the State Court of Dekalb County for the State of Georgia. James filed his lawsuit on multiple counts, including defective design, failure to warn, breach of express warranty, and negligence, among several others.
M2a Magnum Hip Implant Complications
Metal-on-metal hip systems like the M2A Magnum hip implant manufactured by Biomet were developed in order to help reconstruct hip joints affected by conditions like rheumatoid arthritis, osteoarthritis, avascular necrosis, or fracture.
However, despite the common use of these metal-on-metal devices, a slew of lawsuits filed over the years have claimed that metal-on-metal devices—including the M2a Magnum hip implant—are both defective and dangerous, allowing metal components to rub together and release metal particles into the body. If allowed into the bloodstream or surrounding tissue, metal particles can cause metallosis, toxicity, and even device failure.
According to lawsuits, the design of these devices did not go through sufficient testing. Plaintiffs allege that even though Biomet was aware of the complications associated with the device, it placed company profit over patient safety, choosing to downplay and cover up the risks.
Filing a Hip Implant Lawsuit
In previous hip implant lawsuits, some plaintiffs have received hundreds of thousands of dollars in compensation for their injuries.
