After suffering from metallosis and other serious complications, a Florida man recently decided to pursue a DePuy Pinnacle lawsuit over his injuries.
According to this DePuy Pinnacle lawsuit, plaintiff Frank P. was implanted with a metal-on-metal Pinnacle device from DePuy on March 17, 2003.
However, sometime after being implanted with the device, Frank alleges he began experiencing serious complications, including debilitating pain, instability, pseudotumor growth, and adverse local tissue reaction.
Then, in 2013, a blood test revealed that Frank had high levels of the metals cobalt and chromium in his blood. As a result of these injuries, Frank ended up having his DePuy Pinnacle device removed, and was subsequently re-implanted with a ceramic-on-poly device that would not cause these metallosis problems.
According to the DePuy Pinnacle lawsuit, the manufacturers took “no steps” to properly test its Pinnacle device prior to release onto the market. If they had, the DePuy Pinnacle lawsuit claims, they would have discovered its serious risks, including metallosis.
The DePuy Pinnacle lawsuit was filed on multiple counts, including negligence, defective manufacture, design defect, failure to warn and breach of express and implied warranties.
DePuy Pinnacle Basics
The Pinnacle hip device was released onto the market in 2001 by DePuy Orthopaedics, whose parent company is pharmaceutical giant Johnson & Johnson. The DePuy Pinnacle device was intended to replace hip joints damaged by a number of conditions.
This hip implant device is actually a very popular hip implant option, widely used across the country. According to DePuy’s records, nearly 150,000 people have undergone a total hip replacement with this particular system.
Unfortunately, this widespread usage of the DePuy Pinnacle hip implant means that any defects have the potential to affect a large number of patients.
The DePuy Pinnacle hip implant has been linked with a number of serious problems, including metallosis, toxicity, and a high failure rate.
Filing a DePuy Pinnacle Lawsuit Over Injuries
Thousands of hip implant lawsuits have so far been filed over serious problems with the DePuy Pinnacle device. Australia has even responded by taking the DePuy Pinnacle hip implant off its medical market because of its high rate of failure.
Litigation like this DePuy Pinnacle lawsuit claims that DePuy failed to adequately warn the public and the medical community about the risks associated with the DePuy Pinnacle hip implant device. Had the plaintiffs been adequately informed of these risks, lawsuits claim, they may not have had the device implanted in the first place and could have avoided these painful hip replacement problems.
If you or someone you love has experienced hip replacement problems due to a hip replacement with the DePuy Pinnacle hip implant, you may be able to file a DePuy Pinnacle lawsuit.
While filing a DePuy Pinnacle lawsuit cannot take away the pain and suffering caused by device defects, it can help to alleviate the financial burden caused by medical expenses and lost wages.
The DePuy Pinnacle Lawsuit is Case No. 3:17-cv-01878-K, in the U.S. District Court for the Northern District of Texas, Dallas Division.
