An Ohio man recently filed a new DePuy ASR hip lawsuit, alleging that he suffered from serious device complications that required him to undergo revision surgery.
The plaintiff, Brett K., alleges he was initially implanted with a DePuy ASR hip device in his left hip in March 2009. Unfortunately, in the following years after implantation, Brett says he began experiencing severe side effects.
According to the DePuy ASR hip lawsuit, these complications include pain, difficulty walking, muscle loss, tissue destruction, and high levels of cobalt and chromium in his body from the device. He was also hit with further medical bills to treat these issues. Because of these complications, Brett says he had the DePuy ASR hip implant explanted in December 2017.
Brett claims that his injuries came as a direct result of a defective implant, which he only found out after he learned that the device had been recalled. Brett’s DePuy ASR hip lawsuit was filed on multiple counts, including negligence, defective design, manufacturing defect, failure to warn, breach of express and implied warranties, fraudulent misrepresentation and concealment, and a slew of others. Brett’s wife Krista N. also filed on one count of loss of consortium.
The lawsuit was filed on April 16, 2018 in the U.S. District Court for the Northern District of Ohio.
The U.S. Food and Drug Administration (FDA) issued a recall of the DePuy ASR hip implant device back in August 2010, affecting around 93,000 total hip implant devices across the world. Around a third of these recalled devices were implanted in American patients.
A UK study of the DePuy device found that around 13 percent of patients with DePuy ASR implants are eventually forced to undergo hip revision surgery due to injuries or complications. Revision surgery can present serious risk of infection or further device failure, as well as significant medical expenses.
Filing a DePuy ASR Lawsuit
A growing number of patients like Brett who have been undergone revision surgery due to problems with their DePuy ASR hip implant are filing lawsuits, alleging that the manufacturer failed to adequately warn of the risk. Thousands of lawsuits have been filed over side effects like device failure or dislocation, tissue death, metallosis, cancer and others.
The lawsuits claim that DePuy failed to adequately warn both the public and the medical community about the risks associated with their device. Had plaintiffs known about the risks linked with the DePuy hip implant device, the DePuy ASR lawsuits claim, they would have chosen a safer alternative and avoided these complications altogether.
If you or someone you love has suffered from side effects after implantation with a DePuy ASR hip implant device, you may be able to file a DePuy ASR lawsuit. While filing a DePuy ASR lawsuit cannot take away the pain and suffering caused by a defective hip implant, it can help to alleviate the financial burden caused by medical expenses and lost wages.
The DePuy ASR Hip Lawsuit is Case No. 1:18-dp-20028-JJH, in the U.S. District Court for the Western District of the Northern District of Ohio.
