cash from settlementsAfter DePuy’s popular ASR hip implant was recalled, a growing number of patients have begun filing lawsuits, pursuing a DePuy hip settlement. According to lawsuits, patients claim that their DePuy hip implants are defective, and have subsequently led to a number of serious complications.

Several major settlements have been reached. A DePuy hip settlement may amount to hundreds of thousands or even millions of dollars for a group of lawsuits.

Background of the DePuy Hip Implant Recall

Every year, thousands of Americans undergo hip replacement surgery, making it one of the most common surgical procedures. In total, over half a million Americans have undergone hip replacement surgery, and a large portion of these implants are metal-on-metal devices like the DePuy hip implant.

Despite the popularity of the DePuy hip implant and other metal-on-metal devices, a growing number of hip implant patients are coming forward with complaints of serious complications.

The U.S. Food and Drug Administration (FDA) has received countless reports of device failures and other serious side effects, and subsequently issued a recall of the DePuy hip implant in August 2010. Around 93,000 total patients were affected across the world, and about a third of these defective implants belonged to American patients.

For many patients, complications with a hip implant necessarily leads to hip revision surgery to remove the defective device and replace it. Revision surgery brings with it its own dangers, as well as increased medical expenses.

Even after the recall, thousands of Americans may still be implanted with a DePuy hip implant, meaning they are still at risk of the complications warned about by the FDA.

Successful Hip Settlements

A number of major companies have reached massive hip settlements, including DePuy.

Johnson & Johnson reached a settlement in August 2013 for three separate cases, amounting to $200,000 each. Several weeks later, Johnson & Johnson ended up settling more than 7,000 similar lawsuits over defective hip implants. Johnson & Johnson set aside $4 billion to settle the thousands of hip replacement claims.

DePuy has also reached a major settlement agreement. A March 2015 DePuy hip settlement amounted to $420 million, which went to settle around 1,800 total claims. The DePuy hip settlement applied to patients who had revision surgery between Aug. 31, 2013 and Jan. 31, 2015. A recent modification of this settlement now offers compensation for patients who underwent more recent revision surgeries.

Pursuing a DePuy Hip Settlement

Hip replacement patients who have since suffered injuries, in some cases necessitating hip revision surgery, may be able to pursue a DePuy hip settlement and receive compensation. Nearly 10,000 people have sued DePuy so far over hip implant complications. Though some have reached a DePuy hip settlement, thousands are as of yet unresolved.

If you or someone you love has experienced complications due to a metal-on-metal hip implant from DePuy or another company, you may be able to file a metal hip implant failure lawsuit. Patients eligible for a DePuy hip settlement include those who have had hip implant surgery since March 2015.

Of course, a DePuy hip settlement cannot take away the pain and suffering caused by device complications, but it can help to alleviate the financial burden from medical expenses and lost wages.
