A new lawsuit has joined the IVC filter multidistrict litigation, claiming that the Cook Celct Vena Cava Filter is defectively designed and that the manufacturer was negligent in its actions.
Florida Plaintiff Shearickel P. states that she had the Cook Celect Vena Cava Filter implanted in March 2013. The short form complaint does not go into details on the negative side effects that she personally experienced, but typically those who filed Cook Celect Vena Cava Filter lawsuits experienced complications that require emergency medical treatment.
Shearickel has brought forth eight counts against the device manufacturers, including strict products liability for failure to warn design defect, negligence, negligence per se, breaches of express and implied warranty, violations of Florida state law prohibiting Consumer Fraud and Fair and Deceptive Trade Practices and punitive damages. She is seeking a trial by jury.
The Cook Celect Vena Cava Filter Lawsuit is Case No. 1:17-cv-00648-LJM-MJT, in the U.S. District Court for the Southern District of Indiana, Indianapolis Division.
What is a Cook Celect Vena Cava Filter?
A Cook Celect Vena Cava Filter is a specific type of inferior vena cava (IVC) filter, manufactured by Cook. Other manufacturers also make this small medical device, and are included in the IVC filter multidistrict litigation.
Specifically, an IVC filter is used to stop a blood clot from traveling from the lower part of the body back to the heart or lungs, where it can do significant damage or even cause death. The small cage-like device is implanted into the large vein that travels from the lower body back to the heart and lungs, known as the inferior vena cava.
IVC filters are typically used by patients who are unable to take oral anticoagulant medications. These devices can be implanted permanently, or on a temporary basis, such as the Cook Celect Vena Cava Filter.
Essentially, the small device works to trap blood clots so they cannot reach the lungs or heart to do damage. Once trapped, the body can naturally break down the clot so it dissolves.
However, a number of complications can arise from the use of a Cook Celect Vena Cava Filter or other IVC filter. Such complications include device fracture or breakage, which may cause the broken pieces to travel throughout the body, device tilting, which renders the device less effective or even useless, device migration, where the entire medical device travels to a different location in the body, and organ perforation, which can cause significant damage.
Plaintiffs who go on to file a Cook Celect Vena Cava Filter lawsuit have suffered from these complications, and many have found that the device caused them more problems than it was intended to prevent. Oftentimes, they state that had they known the risks associated device’s use, they would have chosen not to have it surgically implanted.
