A Texas couple has filed a Bair Hugger deep joint infection lawsuit against 3M claiming that their medical device caused the husband irreparable harm.

Plaintiffs Lino and Diana D. are filing this civil action under the Bair Hugger Forced Air Warming Products Liability Litigation MDL.

In July 2012 Lino underwent a surgery in a hospital in Corpus Christi, Tx. During the surgery, 3M’s product, the Bair Hugger Forced Air Warming System was used to keep him warm.

However, Lino claims that as a result of the use of the Bair Hugger system, many complications occurred.

According to this Bair Hugger deep joint infection lawsuit, Lino developed a periprosthetic joint infection (PJI) which is also known as a deep joint infection (DJI).

As a result, Lino accuses the Bair Hugger System for being responsible for his deep joint infection.

Because of his deep joint infection, the plaintiff was forced to undergo multi-stage revision surgery including an extensive inpatient treatment with intravenous antibiotics, the lawsuit states. This occurred between December 2013 and April 2014.

According to the Bair Hugger deep joint infection lawsuit, Lino holds 3M responsible for damages including injury to himself and economic loss. His wife, Diana, claims loss of services and loss of consortium.

Specifically, this Bair Hugger deep joint infection lawsuit brings claims of negligence, failure to warn, defective design and manufacture, breach of express warranty, consumer fraud, negligent misrepresentation, fraudulent misrepresentation, fraudulent concealment and unjust enrichment.

What is the Bair Hugger System?

The Bair Hugger System, manufactured by 3M, is a device used in hospitals to keep patients warm during surgery.

It is a forced-air warming blanket that is often used for patients undergoing hip or knee replacement surgery.

The disposable blanket is connected to a heater that blows warm air on the patients skin.

It has been shown that if patients can be kept warm during surgery, bleeding is reduced and recovery time is shortened.

However, it has been shown that the forced warm air can spread contaminants and bacteria and put the patient at severe risk for a Bair Hugger deep joint infection.

A 2012 study showed that the Bair Hugger air that is circulated around a patient has 2,000 more contaminants than similar medical devices. This may create a Bair Hugger deep joint infection, according to the lawsuit.

The infections that allegedly come as a result of the Bair Hugger System can mean extensive treatment for affected patients.

These include hospitalization, additional surgeries, joint implant removal and revision, physical therapy, placement of an antibiotic spacer in the infected joint, intravenous antibiotic treatment or amputation.

Bair Hugger Deep Joint Infection Lawsuits

Plaintiffs in other Bair Hugger deep joint infection lawsuits claim that 3M was aware of the risk of severe complications since at least 2009. Even so, they continued to promote the device as safe.
