A Utah couple recently filed a lawsuit against Biomet after allegedly suffering from a metal on metal hip replacement failure.
The metal on metal hip replacement failure lawsuit claims not only that the device was defective, but also that the company was aware and had been aware of the dangerous defects linked with its product.
The plaintiff, Sandra H., was initially implanted with a hip device on September 9, 2005.
After implantation, the plaintiff began experiencing symptoms like debilitating pain, discomfort, soreness, and loss of motion.
According to the lawsuit, the device implanted in the plaintiff was a metal on metal device, meaning that the metal components of the device’s ball-and-socket function continuously rubbed each other over time as the patient moved.
The lawsuit alleges that the metal components rubbing together created metal debris, which was allowed to spread to surrounding bone and tissue in the patient’s body.
The device’s implantation led to metal on metal hip replacement failure, the lawsuit claims, which then led to serious injuries for Sandra H.
The plaintiff’s metal on metal hip replacement failure has led to numerous injuries, including pain, swelling, inflammation, bone and tissue damage, and decreased mobility.
As a result of these complications, Sandra H. had no option but to pursue revision surgery to remove the defective device and prevent further damage, the lawsuit alleges.
The revision surgery was performed on February 15, 2015.
Unfortunately, despite the necessity of the revision surgery, these surgeries expose patients to an increased risk of complications or even fatality.
Even when a patient recovers fully from a revision surgery, their recovery time is lengthy and more painful than the original surgery, and also incurs extra medical costs.
Metal on Metal Hip Replacement Failure
The Biomet Metal-on-Metal Hip System, like other hip implant devices, was developed in an effort to reconstruct the hip joints of those that suffer from conditions like osteoarthritis or fracture.
These implants are designed with metal balls placed in direct contact with another metal piece known as the metal acetabular shell. Most hip implants are different, and use a plastic liner to separate these metal parts from each other.
Lawsuits filed after patients suffer from metal on metal hip replacement failure claim that this design is defective and dangerous.
Biomet lawsuits allege that the design was insufficiently tested, and when Biomet had knowledge of the defects and risks, it sought to cover them up to bolster sales.
