In 2010 Johnson & Johnson issued a voluntary DePuy ASR hip implant recall, following reports of dangerous side effects associated with the implant. The recall affected 93,000 DePuy ASR hip implants across the world, including almost 40,000 in the United States.

However, patients are still claiming that they are suffering serious side effects from this and other DePuy devices. According to the short form complaint of a new MDL against DePuy, some patients who were implanted with the device prior to the recall are just now beginning to suffer the side effects.

DePuy ASR Hip Implant Recall MDL

Plaintiff Anthony G. says he was implanted with the DePuy ASR hip implant March 9, 2010. Following the replacement of his right hip with the DePuy device, Anthony claims that he began to experience side effects and injuries.

After hearing about the DePuy recall, Anthony says he had a blood test, and was informed that his blood contained excessive levels of chromium and cobalt, also known as metallosis. He alleges that he has suffered bodily injury directly related to the hip implant, as well as a loss of income stemming from the pain and ongoing injuries he suffers.

DePuy ASR Hip Replacement Complications

There are many possible complications related to the DePuy ASR hip prosthetic device, including hip replacement failure. Possible hip replacement complications include:

  • Dislocation of the hip
  • Leaking of toxic substances from the implant into the bloodstream
  • Degenerative heart disease
  • Loss of bone strength
  • Bone fractures
  • Tissue death
  • Tumors
  • Metal poisoning from chromium or cobalt particles
  • An increased risk of cancer from toxic chemicals and metal poisoning

DePuy agreed to pay $120 million in multistate litigation alleging that the company deceptively marketed its metal on metal hip implants, using false claims to promote the products. According to RY Ortho, 46 attorneys general brought the suit against DePuy and Johnson & Johnson.

Additionally, Johnson & Johnson paid $2.5 billion in 2014 to settle thousands of hip replacement lawsuits claiming that the defective products caused patients to require additional dangerous and painful surgeries to repair or replace DePuy devices.
