One of the most recent claims alleges the patient had to undergo a hip revision operation after suffering serious injuries related to metal-on-metal hip implant complications.

Plaintiff James L. opted to file this DePuy ASR hip lawsuit soon after discovering other patients had suffered similar injuries that forced them to undergo hip revision operation.

According to the DePuy ASR hip lawsuit, James had the DePuy ASR hip replacement system implanted on Oct. 11, 2007 and had no reason to believe he was at risk for serious device complications.

The DePuy ASR hip implant and other metal-on-metal hip replacement models are popular choices among more active patients because they are designed to be more durable than their plastic or ceramic counterparts.

But there have been numerous injury reports submitted over the years, indicating the all-metal ball-and-socket components can cause serious health problems for patients according to VeryWellHealth.

This was reportedly the cases with James, who, according to his lawsuit, had to have the DePuy ASR hip replacement system explanted on Nov. 15, 2018. According to the DePuy ASR hip lawsuit, James’ blood test results showed he had high levels of cobalt and chromium, which caused him pain and suffering.

James also decided to file legal action after learning DePuy Orthopaedics and parent company Johnson & Johnson had recalled certain models of these hip implants in 2010 and has since agreed to settle thousands of ASR hip implant claims.

Overview of DePuy ASR Hip Implant Complications

The DePuy ASR hip replacement settlement is for patients who had to undergo revision surgery due to the metal-on-metal hip implant complications allegedly caused by the prosthetic.

The FDA announced a voluntary recall of 93,000 DePuy ASR hip implants worldwide on Aug. 24, 2010, with 37,000 implants in the United States.

The recall was issued after new data had been released from the United Kingdom joint registry, which found that 13 percent of DePuy ASR hip implant patients had to undergo revision surgery due to serious device complications.

The all-metal ball-and-socket components of the device could cause metallosis, or blood metal poisoning, which could quickly cause a multitude of other problems including:

  • Fretting
  • Corrosion
  • Debilitating pain
  • Limited movement
  • Infection
  • Formation of pseudotumors
  • Cardiomyopathy
  • Increased cancer risk

These painful complications are often only resolvable through revision surgery, which is considered riskier than the initial implant surgery.

Even though these complications can be devastating to patients, DePuy Orthopaedics allegedly failed to warn the general public of this information, according to the lawsuit.

James’ DePuy ASR hip lawsuit is joining MDL No. 2197, where it will stand alongside other claims alleging similar metal-on-metal hip implant complications. James is seeking damages for negligence and failure to warn, with his claim set to be streamlined through the litigation process by joining the MDL.

This DePuy ASR Hip Lawsuit is Case No. 1:18-dp-20099-JJH, in the U.S. District Court of Northern Ohio, Western Division.
