Stryker metal hip implant hip replacementA Louisiana woman recently filed a DePuy hip implant lawsuit against the medical device manufacturer, alleging serious injuries caused by a defective device.

The plaintiff, Margaret P., was implanted with a DePuy ASR hip implant in December 2007. Unfortunately, in the following years, Margaret says, she began experiencing severe complications. By July 2017, Margaret suffered from a condition known as metallosis, a kind of metal poisoning caused by the metals of the hip implant rubbing together.

Margaret claims she was left with excessive amounts of chromium and cobalt in her blood. These injuries led to medical bills, wage loss, and other expenses, as well as emotional distress, she says. Later, Margaret learned that DePuy ASR hip implant devices had been recalled due to metal-on-metal defects.

According to her DePuy hip implant lawsuit, Margaret’s injuries were a direct result of DePuy’s defective device. Had she known about the risks of metallosis from using a metal-on-metal-device, Margaret alleges she would have chosen a safer option.

The DePuy hip implant lawsuit was filed on multiple counts, including negligence, defective design, manufacturing defect, failure to warn, breach of express and implied warranties, fraudulent misrepresentation and concealment and several others. Margaret’s husband Wayne also filed on one count of loss of consortium.

DePuy ASR Hip Implants

The DePuy ASR hip implant was approved by the U.S. Food and Drug Administration (FDA) in 2005. However, the FDA issued a recall of the device in August 2010. The DePuy ASR hip implant recall affected around 93,000 total patients.

Margaret and her husband are far from the only plaintiffs to have suffered from the side effects of metal-on-metal hip implants. More than half a million patients in the U.S. have been implanted with these devices so far.

Unfortunately, metal-on-metal implants like the DePuy ASR device have been linked with serious complications, including metallosis. More and more hip implant patients are coming forward with reports of serious side effects.

Patients have also claimed that their implants led to other side effects, including the following:

  • Device failure
  • Dislocated hip
  • Metallosis
  • Cancer
  • Degenerative heart disease
  • Bone fractures
  • Death of surrounding tissue
  • Others

Filing a DePuy Hip Implant Lawsuit
