The DePuy Orthopaedics multidistrict litigation (MDL) gains another metal hip implant lawsuit, after a married couple alleges the company’s ASR hip implant completely failed.
After getting getting the device implanted, the husband allegedly suffered metal hip implant failure and has had to contend with a number of medical issues as a result.
Texas plaintiff couple Michael S. and Karen S. are filing legal action against DePuy Orthopaedics for failing to warn them of the potential complications associated with their ASR hip implant. The metal hip implant failure has allegedly caused permanent impairment in their marriage.
Michael had originally opted for the ASR hip implant after discussing it with his physician and reviewing DePuy Orthopaedics’ marketing statements. Michael had the device implanted in his right hip on Jan. 21, 2008, having no reason to expect any complications.
At no point before or after the all metal hip implant was implemented did the company warn Michael or his wife of the chronic problems he could potentially suffer. Michael had to discover this first hand, when he began to feel the symptoms of metal hip implant failure.
Overview of Metal Hip Implant Failure
According to the metal hip implant lawsuit, Michael had undergone severe pain and suffering, metallosis, and was unable to walk.
Metallosis, or blood metal poisoning, occurs when metal ions are shed into the body from the interactions of the metal ball and socket joints. This can also lead to device corrosion and failure, infection, the formation of pseudotumors, and often debilitating pain.
These symptoms are often reported from metal hip implant failure, with some patients having to undergo multiple surgeries to resolve the complications.
It is important to note that Michael was not aware he was suffering metallosis until blood tests confirmed the condition. Due to the complications of his own metal hip implant failure, Michael had to undergo revision surgery to remove the implant on June 15, 2016.
Michael eventually learned of the serious side effects associated with metal hip implant failure, after the device was recalled from the market.
The ASR implant and other metal on metal hip implants were thought to be superior to their ceramic and plastic counterparts, due to their durability and customization features, but such was not the case.
Michael and many other patients have suffered metal hip implant failure, in alleged result of the marketing statements made by DePuy Orthopaedics and other manufacturing companies.
Michael states that he would not have opted for the ASR hip implant if he had known the complications of metal hip implant failure.
The Metal Hip Implant Failure Lawsuit is Case No. 1:16-dp-20141, in the U.S. District Court of Northern Ohio, Western Division.
