Bayer was hit with an Essure lawsuit by a several women who alleges that the permanent birth control option caused them to suffer from severe side effects.
One of the plaintiffs involved in this Essure lawsuit, plaintiff Shelly C., underwent the Essure procedure on her left side in August 2012. In February 2013, she followed this up with a second Essure procedure on the other side.
Shortly after her surgery, Shelly was told that her Essure coils had been placed properly and her tubes successfully blocked.
However, as time went on during her post-procedure recovery, Shelly began experiencing increasingly severe pain. Shelly reports experiencing pelvic pain, back pain, and migraine headaches. In addition to physical pain, Shelly also reports loss of libido and hair loss, as well as fatigue and weight gain.
She claims that these symptoms began only after her Essure procedure.
Though Shelly sought to alleviate these symptoms through treatment from various physicians, they could not pinpoint the cause of her problems. Because of this, Shelly continued to experience these complications for a number of years.
In October 2015, however, Shelly underwent a hysterectomy for Essure removal. Afterwards, her surgeon told her that the Essure coil on her right side had migrated after its initial placement, and had become embedded in her uterus, causing the pain and other complications she had been experiencing for years.
This Essure lawsuit was filed on multiple counts, including negligence, failure to warn, fraudulent concealment, and violation of consumer protection laws.
Essure Procedure Background
The Essure device is a permanent birth control method developed by Conceptus. In 2013, Bayer agreed to buy Conceptus for about $1.1 billion.
Essure birth control consists of two metal coils which are implanted into a patient’s fallopian tubes. After the Essure procedure, the coils expand in the months following, allowing tissue to grow around them, eventually blocking the tubes and preventing conception.
Reported Essure Side Effects
Women who have used Essure birth control have reported severe side effects. The side effects cited in the Essure lawsuit include:
- Bloating
- Rashes
- Allergic reactions
- Excessive bleeding
- Organ perforation
- Pelvic pain
- Miscarriage
- Ectopic pregnancy
Filing an Essure Lawsuit
Bayer markets Essure as more simple, safe, and effective than other permanent birth control options available to women. Many women have gone through the Essure procedure for permanent contraception.
In 2007, it was estimated that as many as 700,000 American women undergo tubal ligation each year. However, thousands of these patients have later filed FDA adverse event reports or even an Essure lawsuit.
This Essure lawsuit and others like it allege that Bayer either knew or should have known about the serious complications associated with its birth control device.
Essentially, the Essure lawsuit claims that Bayer intentionally concealed information about Essure’s problems in order to place company profit over consumer safety.
