DePuy ASR Hip SettlementJohnson & Johnson subsidiary DePuy Orthopaedics Inc. has agreed to privately settle some of the ASR hip implant lawsuits that are part of ongoing multidistrict litigation (MDL) against the medical device manufacturer. Eligible plaintiffs include ASR patients in the United States who had revision surgery to replace their ASR XL Acetabular Hip System or ASR Hip Resurfacing System on or before Aug. 31, 2013.

Qualified plaintiffs with ASR hip implants may be eligible to receive a base award of $250,000. This base award is subject to reductions depending on the following factors:

  • How long the ASR was implanted
  • Whether you had hip replacement surgery in the same hip before the ASR was implanted
  • Your age when the ASR was implanted
  • Whether you smoked at the time of your revision surgery
  • Whether your Body Mass Index (BMI) was greater than 35 when the ASR was implanted
  • For cases involving deceased patients, whether the patient died shortly after the ASR revision surgery for reasons unrelated to the procedure

Patients who can show they suffered extraordinary injuries related to their DePuy ASR hip implant may be eligible to receive a supplemental award. Among those who may qualify for a supplemental award include patients who:

  • Had bilateral surgery (surgery on both hips)
  • Had or will require multiple revision surgeries following the ASR implant surgery
  • Experienced extraordinary medical events associated with the revision surgery, such as heart attack, stroke, deep vein thrombosis, pulmonary embolism, foot drop or dislocations
  • Experienced certain extraordinary injuries in a specified time frame in the future

The amount of each individual award under the U.S. ASR Settlement Program will be determined by on a case-by-case basis. Patients must submit medical records that show they were implanted with an ASR hip implant as well as records related to the implant and revision surgeries.

The only way to qualify to receive a monetary award from the DePuy ASR settlement is to register your claims online by Jan. 6, 2014. Once registered, you must submit the required forms and documentation to the claims processor no later than April 1, 2014. Enrollment forms and registration materials will be available at the following website: www.USASRHipSettlement.com.
