Boston Scientific to pay $189 million to end surgical mesh lawsuit

Medical device maker, Boston Scientific, will pay $188.7 million to end a lawsuit filed by 47 US states alleging it misled the public about the safety of its transvaginal mesh products.  

Washington D.C., along with 47 state attorneys general, reportedly claimed that Boston Scientific hid serious side effects of their transvaginal mesh products from patients and doctors. These side effects allegedly included pain, urinary dysfunction, and incontinence.  

In addition to the multimillion-dollar payout, Boston Scientific has reportedly agreed to disclose more information about the risks and safety of its mesh products as a part of the settlement agreement announced this week. The settlement will be distributed among the states who filed the lawsuit 

“While Boston Scientific was putting income before the health of people in need of care, women were put in danger,” New York Attorney General Letitia James said in a statement, according to Reuters 

Boston Scientific’s products included pelvic mesh, also known as transvaginal mesh. The devices were used to treat pelvic organ prolapse and stress urinary incontinence; however, many patients reported problems with the mesh once it was implanted. If you were forced to have revision surgery to correct a problem caused by transvaginal mesh, you could join a lawsuit investigation.

Companies Pay Millions to End Transvaginal Mesh Lawsuits

In addition to the most recent settlement with Boston Scientific, other transvaginal mesh makers have paid millions to end litigation over their devices. In 2019, Ethicon agreed to pay $117 million to end a similar lawsuit brought by 41 states and Washington D.C. Last year, C.R. Bard entered into a $60 million settlement agreement with 48 states over its transvaginal mesh devices.  

Other states have filed independent action against medical device companies over their transvaginal mesh, including an $800 million lawsuit filed against Ethicon, a subsidiary of Johnson & Johnson, by California’s attorney general.  

Further, Boston Scientific, along with other pelvic mesh manufacturers face legal action by patients who say they were not adequately informed of the serious risks of these medical devices. Legal experts have estimated that vaginal mesh injury settlements could reach as much as $11 billion.  

In 2019, Boston Scientific reportedly agreed to pay $600 million to end 50,000 patient lawsuits over its transvaginal mesh 

The company has also been ordered to recall certain vaginal mesh products, reports Reuters. In 2019, citing a lack of safety assurances for their devices, the U.S. Food and Drug Administration ordered Boston Scientific and another transvaginal surgical mesh implant manufacturer, to pull the products from the market.

“We are pleased to resolve this dispute and to continue focusing on delivering innovative products and solutions to physicians and patients,” the company reportedly said in a statement issued after this most recent settlement.

    I had the Boston Scientific bladder mesh surgery in November 2011. I have had repeated painful UT’s since that time. I have all documentation.
    Please have someone contact me.

    I received a settlement through Boston Scientific in 2020 due to complications I had with the bladder sling and mesh. When I had surgery to remove the eroded mesh only one side of the mesh/bladder sling was removed. I am still suffering complications from the mesh that is still inside my body and I need additional surgery to fix this. My loss of bladder control has got so much worse also and I continue to be in pain every day. Am I eligible to apply for an additional settlement because I continue to suffer with medical problems and because additional surgery is needed.

      I’m having the same problem! I have to have another surgery.., I think they had an extra form at the end of the settlement which stated that they had extra $ set aside because of this problem. Let me know if you find out anything!!!
