A new class action lawsuit claims The Procter & Gamble Co. falsely advertises its ZzzQuil sleep aid products as being natural.
Plaintiff Timothy Singer claims the company’s ZzzQuil PURE Zzzs melatonin products contain synthetic ingredients despite being marketed as helping consumers “fall asleep naturally.”
Singer argues P&G’s ZzzQuil products contain several artificial and synthetic ingredients, including the melatonin in the product. He claims the melatonin in the sleep aid is a “highly synthesized chemical that does not exist in nature,” which P&G makes in a laboratory.
The plaintiff claims P&G uses the “naturally” branding strategy and labeling claim as the primary feature differentiating the ZzzQuil products from other sleep aid products in the marketplace.
“Reasonable consumers certainly would not expect the primary ingredient printed on the front of the label to be a non-natural, highly processed chemical,” the ZzzQuil class action says.
ZzzQuil class action claims consumers deceived by ‘naturally’ tagline
Singer argues P&G’s ZzzQuil products contain a long list of synthetic and coloring ingredients and chemical compounds that customers would not expect in a natural substance.
“Plaintiff brings this action individually and on behalf of other similarly situated consumers in Florida to halt the dissemination of P&G’s false and misleading advertising message, correct the false and misleading perception it has created in the minds of consumers and obtain redress for those who have purchased the Products,” the ZzzQuil class action says.
Singer claims P&G violated Florida’s Deceptive and Unfair Trade Practices Act and engaged in false advertising and marketing designed to cause consumers to purchase the ZzzQuil products.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory damages for himself and all class members.
In January, P&G was hit with a similar class action lawsuit alleging the company falsely advertises a line of its ZzzQuil melatonin sleep aid products as able to help consumers fall asleep naturally.
