Ziploc class action lawsuit overview:

  • Who: A consumer filed a class action lawsuit against S.C. Johnson & Son Inc.

A new class action lawsuit alleges that Ziploc bags and containers are falsely marketed as being microwave and freezer-safe despite potentially releasing microplastics when microwaved or frozen.

Plaintiff Linda Cheslow claims S.C. Johnson falsely markets its Ziploc bags and containers as being microwave and freezer safe despite the products being made from polyethylene and polypropylene — materials that allegedly release microplastics when microwaved or frozen.

“Relying on Defendant’s false misrepresentations, individuals have unwittingly exposed themselves and their families to undisclosed microplastics during routine kitchen practices,” the Ziploc class action lawsuit states.

Cheslow wants to represent a nationwide class and California subclass of consumers who purchased Ziploc bags or containers during the applicable statute of limitations period.

Ziploc bags pose ‘serious health risks,’ class action alleges

Cheslow argues that S.C. Johnson’s alleged failure to disclose that its Ziploc bags and containers release microplastics when microwaved or frozen is significant to consumers, as the ingestion of microplastics poses “serious health risks.”

“The Material Omission leads reasonable consumers to believe that the Products do not pose a risk of microplastic exposure and contamination of their food, which in turn creates a false sense of security,” the Ziploc lawsuit states.

Cheslow claims S.C. Johnson is guilty of false advertising and unjust enrichment while violating California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act.

Cheslow demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, statutory and punitive damages for herself and all class members.

In 2022, Ziploc was hit with a lawsuit alleging the company used false advertising techniques to misrepresent the quality of some of its Ziploc storage bags.

    I have been buying ziplock freezer bags of 152 for years from Sam’s club. I always uses them to break my meat down into serving sizes. I just brought some last week as a matter of fact. Sign me up.
